Orange County, Vermont Building Permit Guide

To get a building permit in Orange County, confirm which office issues permits for the property’s address, then submit the application with your plans and required documents, pay the permit fees, and pass inspections before final approval. Alliance Permitting can prepare, file and track the permit for you and schedule the inspections.

Orange County has no permit office: Randolph, Bradford, Thetford and eight other towns issue zoning or development permits, six towns have no zoning but regulate their floodplains, and state offices permit public buildings, septic systems and Act 250 projects.

Orange County itself issues no permits. Eleven of its 17 towns issue zoning or development permits under their own bylaws, and Randolph states plainly that it does zoning only, with no local trade permits or building inspections. Rentals and commercial buildings need a state construction permit from the Division of Fire Safety, and Fairlee, for example, charges $415 in zoning fees for a new 2,000 sq ft house.

What needs a permit in Orange County?

In the 11 towns with zoning or a development ordinance, building, enlarging, moving or changing the use of a structure needs a town permit first. Brookfield’s forms page says permits must be approved before building new structures or modifying or enlarging existing ones, and Vershire’s Development Ordinance, in place since 1994, covers construction, conversion, relocation and enlargement of buildings and changes of use. Some small work is exempt: Chelsea does not require a zoning permit for structures under 100 sq ft that are not for human occupancy, though they must still meet setbacks.

Town level

  • Zoning or development permit for new buildings, additions and changes of use
  • Development Review Board or Zoning Board review for conditional uses, variances and subdivisions
  • Flood hazard permits, including in towns with no other zoning
  • Access and right-of-way permits for town roads

State level

  • Division of Fire Safety construction permit for public buildings, rentals included
  • Electrical and plumbing work notices before regulated work starts
  • DEC wastewater system and potable water supply permit
  • Act 250 permit for larger developments

Orange County building department: who handles permitting

Vermont counties are not permitting governments, so an Orange County project goes to its town and to the state. The Census Bureau lists 17 towns and two incorporated villages, Newbury and Wells River, both inside the Town of Newbury and both zoned under its regulations.

Towns with flood rules but no zoning: Corinth says no zoning ordinance is in effect other than its flood hazard area zoning of May 2015; it also has subdivision bylaws (2017) administered by its Planning Commission (802-439-5850). Tunbridge issues a floodplain development permit under its flood hazard ordinance (802-889-5521). Williamstown requires a conditional use permit only for building in the flood hazard area defined by its flood hazard bylaws (802-433-5455). West Fairlee adopted a stand-alone flood hazard area bylaw in December 2024 (802-333-9696 ext. 101). Orange has no zoning bylaws, according to a 2025 study the town posted, but its Inundation Hazard Area Regulations, last updated in 1988 with amendments proposed in 2014, govern building in the mapped flood hazard area (town clerk 802-479-2673). Topsham’s 2012 town plan says it has no zoning bylaws, but under the Flood Hazard Bylaw it adopted in 1979 a town permit is needed for new construction or substantial improvement in the designated floodplain (town clerk 802-439-5505).

State offices: the whole county is in the Division of Fire Safety’s Waterbury region (45 State Drive, Waterbury; 802-479-4434). DEC’s Montpelier Regional Office at 1 National Life Drive issues wastewater and water supply permits for all 17 towns (802-828-5034, by appointment). Act 250 is split: Washington, Williamstown and Orange are in District 5 (802-522-6428) and the other 14 towns in District 3 (802-261-1947); both commissions are at 10 Baldwin Street, Montpelier.

Orange County town applications

  • Thetford takes zoning permit applications on paper at the town office with the fee; they cannot be emailed. The part-time office asks applicants to plan ahead, because hearing notices push deadlines well before the Development Review Board’s 2nd and 4th Tuesday meetings. Farm structure exemptions are decided by the Agency of Agriculture through its Farm Determination Form.
  • Randolph applications are in the bin beside the zoning office door or online, and can be submitted in person or by email. The town has 30 days from a complete application to issue or deny a permit.
  • Fairlee has separate residential and commercial permit applications and an appeal form for zoning administrator decisions.
  • Braintree no longer includes the certificate of occupancy in the zoning fee; the zoning administrator decides whether one is needed.
  • Washington updated its zoning permit and subdivision applications in April 2026.
  • Vershire has separate minor and major subdivision applications.
  • State: Division of Fire Safety construction permits use the full application or, for renovations under $200,000, the small project form; DEC wastewater permits are filed through ANR Online.

Each town sets its own fees. These are the schedules posted by five of them:

Brookfield, certificate of use$35

Under Fairlee’s 2026 schedule a new 2,000 sq ft house costs $100 + $300 + $15 = $415. Thetford’s fee schedule took effect on May 1, 2024, and Newbury posts a 2019 schedule. State construction, work notice and wastewater fees are separate.

Electrical, plumbing and fire safety permits

Randolph’s zoning page says there are no trade permits or building inspections at the local level, though they may be required by the state. Across the county, construction in public buildings, which include rentals, needs a Division of Fire Safety permit, and the electrical and plumbing work it regulates needs a work notice before work starts, on paper or online. Fire alarm, sprinkler, suppression, exhaust hood, tank and tent permits each have a separate state application.

Inspections in Orange County

Town permits are land use approvals; Randolph, the county’s largest town, does no building inspections. State inspectors from the Waterbury Regional Office cover public buildings and regulated electrical and plumbing work. Fairlee will do a site inspection with its $100 certification of compliance, and Braintree decides case by case whether a certificate of occupancy is needed.

The Residential Building Energy Standards apply to all new residential construction, including additions, alterations, renovations and repairs. The builder, or a licensed engineer, licensed architect or accredited home energy rating organization, signs the certificate, which is posted at the heating or cooling equipment or electrical panel, sent to the Department of Public Service and recorded in the town land records; either the 2020 or the 2024 standards may be used since July 14, 2026.
