Rockport, Texas Building Permit Guide

Inside Rockport city limits, the City’s Building and Development Department at 2751 SH 35 Bypass reviews plans, issues building and trade permits, inspects the work and issues certificates of occupancy. Until a new fee schedule is adopted, the City charges $0.60 per square foot for residential permits and $0.10 per square foot for each other trade. Its goal is to have a permit ready within 10 business days for a one- or two-family home and 20 business days for other projects.

What needs a permit in Rockport?

A permit is needed to construct, enlarge, alter, repair, move or demolish a building or structure, or to change its occupancy. The City’s October 2025 Development Guide lists what is exempt:

  • New homes, additions, remodels and repairs
  • Commercial and industrial buildings and finish-outs
  • Electrical, plumbing, gas and mechanical work
  • Demolition and moving a building
  • Certificate of occupancy for a new business, tenant change or change of use
  • Signs, including a windstorm (WPI-1) certification
  • Fences over 6 ft, with a site plan
  • Reconnecting an electrical service after the meter is pulled or the drop cut

Exempt

  • Painting, carpeting, fixture replacement and other minor cosmetic repairs
  • A one-story detached accessory structure of 200 sq ft or less
  • Fences of 6 ft or less (no fence permit)
  • Sidewalks and driveways on private residential property

The guide’s building-permit exemption list puts the fence limit at 7 ft, but its fence section says any fence over 6 ft needs a fence permit.

Who issues permits in Rockport?

The Building and Development Department covers minor planning, zoning administration, building permits and inspections, and also handles short-term rental registration. Plats, rezonings, conditional use permits, variances, building permits and certificates of occupancy all go through it, while the fees are collected by the City’s Utility Billing Department. For commercial occupancy, the department asks the Fire Marshal to carry out the fire inspection.

Outside the city: the Development Guide says building construction outside the city limits needs no City building permit, and that in the extraterritorial jurisdiction the City’s authority is limited to platting and the public infrastructure that platting requires; a plumber connecting to City utilities there still needs a City permit. The City’s contractor packet describes the ETJ as reaching 1 mile beyond the city limits. Aransas County handles floodplain, septic and driveway permits on unincorporated land.

How to file, and who may pull permits

The City posts residential and commercial building permit applications, electrical, mechanical and plumbing applications and a contractor registration packet. The packet’s 2025 submittal procedures send the complete plan set electronically to permits@cityofrockport.com, and fence and sign applications can also go in person, through the City’s portal or by email. The older notice on the Permits & Inspections page still says permits are taken only in person or through the portal.

  • Anyone working in Rockport must register with the City, except a homesteaded homeowner doing the work personally.
  • Permit applicants must be the homesteading resident or a licensed contractor, and work on commercial buildings must be done by licensed contractors.
  • One permit cannot cover work on separately platted parcels.
  • Changes to approved drawings need an addendum approved by the Building Official, and engineered items such as truss drawings can follow the permit, but that work cannot start until they are approved.

After H.B. 852 barred cities from basing residential permit fees on the value of the work, Rockport moved to an interim square-foot method based on the ICC building code, pending a new fee schedule:

  • Residential building permit: $0.60 per square foot of total gross footage, counting the dwelling and attached garage.
  • Other trades: $0.10 per square foot.
  • Water and sewer impact fees must be paid before the building permit is issued, and engineering review fees reimbursed.
  • Work started before the permit is issued: a penalty of 400% of the usual permit fee, at least $250, unless the Building Official approves otherwise.
  • Unpermitted extra work found at an inspection: the inspection is cancelled and a penalty of 400% of the total permit fees, at least $250, is charged.
  • Re-inspection: a fee may be charged when work is not ready and the office was not told in advance.

For a 2,000 sq ft house with a 400 sq ft attached garage, the building permit is $1,440 before trade permits and impact fees. Anyone owing fines to the Building Inspection Department cannot schedule inspections or pull new permits until they are paid. A rezoning costs $150 plus $10 per acre.

Since August 1, 2006, all plans must carry a structural engineer’s seal for wind loads or include the engineer’s letter, and no certificate of occupancy is issued without proof the wind-load work was completed (WPI-8). The City’s windstorm framing inspections do not replace Texas Department of Insurance windstorm inspections. State law allows 45 days to approve or deny an application; the City aims for 10 business days on homes and 20 on other projects.

Steps to a Rockport permit

1. Pre-development meeting

Free meetings on Wednesday mornings at 9, 10 and 11 a.m.; send the request form and a Request for Utilities Availability first.

2. Check platting, zoning and flood zone

The lot must be legally platted; ask the Aransas County Appraisal District (361-729-9733) or the department.

3. Register

Contractors register with the City before applying.

4. Submit the plan set

Send the application and plans to permits@cityofrockport.com or bring them to the office.

5. Pay impact fees and permit fees

Water and sewer impact fees are due before the permit is issued; fees are paid to Utility Billing.

6. Post the permit and build

Post it where it is visible from the street, with the 911 address, and start within 180 days.

Inspections in Rockport

The permit holder or their agent calls for inspections (a homesteader doing their own work can request their own), on the 24-hour line, 361-790-1177, or the main number, giving the contractor’s name, inspection type, address, permit number and date needed. Calls by 8:00 a.m. can be inspected the same day; later requests go to the next working day, and inspections run by route rather than first come, first served. The stamped approved plans must be on site, the permit posted, a portable restroom in place before new construction starts, and property lines string-lined before the foundation inspection.

The City’s inspection sequence runs: building setback, underground plumbing, electrical, gas and mechanical, foundation, rough-in plumbing, electrical, gas and mechanical, framing (only after the other rough-ins pass), then plumbing, electrical, mechanical and gas finals and the final building inspection with the permanent address displayed. An engineer’s inspection can replace a City inspection for a sealed foundation, sheathing nailing or other sealed portions, but a setback inspection is still required. Fire inspections for a certificate of occupancy are arranged by the department with the Fire Marshal.

Local rules in Rockport

Flood zones: the residential application records the flood zone from the City’s flood insurance rate map dated February 17, 2016, and requires an 18-inch freeboard above base flood elevation; lots in the 100-year floodplain need an elevation certificate.

Heritage District: alterations to existing structures in the Heritage District need a certificate of appropriateness.

Trees: new construction and additions need a tree survey and mitigation plan with the site plan.

Septic and health: new or modified septic systems are permitted by Aransas County Environmental Health, which also inspects restaurants, day cares and commercial pools (361-790-0121).

Addresses and utilities: street addresses come from the Aransas County Appraisal District. After final inspection, the owner sets up utility accounts; an electrical service whose meter was pulled or drop cut needs a City inspection before the City releases it to the power company.

Meetings: the Planning and Zoning Commission meets on the first and third Mondays at 5:30 p.m. at City Hall, 212 N. Live Oak St., and a rezoning usually takes 8 to 12 weeks.
