Newton County does not require building permits. What it does require, for land outside the City of Newton, is a Floodplain Development Permit from the county’s Floodplain Administrator (509 Main St, Newton; 409-379-2169) before any new construction, mobile home, tiny home, portable building, RV park or subdivision goes in. The permit costs $40 and is valid for 6 months. TCEQ names no county septic agent: septic permits come from its Beaumont regional office, or from the Sabine River Authority within 2,000 feet of Toledo Bend Reservoir.

What needs a county permit in Newton County?

The county’s published requirements for unincorporated land are short:

The county’s notice says the codes in effect are the 2000 International Residential Code and 1999 National Electrical Code, but it issues no building permit to enforce them.

Cities and towns in Newton County

  • Newton (population 1,595), the county seat and the county’s only incorporated city: the City’s website does not publish a building permit process; call City Hall at 409-379-5061. The City supplies its own electric, gas, water and sewer service, and the state floodplain directory lists the City Administrator as the City’s own floodplain administrator, separate from the county program.

Everywhere else in the county is unincorporated, and the floodplain permit is the only county development approval there.

Septic, wells and other work outside the city

Septic: TCEQ’s authorized-agent search lists no county or health district agent for Newton County. Within 2,000 feet of the Toledo Bend Reservoir project boundary the Sabine River Authority permits septic systems; everywhere else the TCEQ Region 10 office in Beaumont is the permitting authority. The county’s own notice sends owners to the Jasper/Newton County Public Health District for septic specifications and inspections. The floodplain order requires on-site waste systems to be located so floodwater cannot damage or contaminate them.

Wells, driveways and culverts: these are listed on the floodplain application and are reviewed under it. The application warns that other permits may be required by the U.S. Army Corps of Engineers (409-766-3982).

Electrical, plumbing and mechanical work: the county publishes no trade permits for unincorporated land.

The permit is issued once payment is received and all requirements are met, and it is valid for 6 months from issue. The county publishes no review time; the office asks applicants to call for an appointment.

Floodplain review, Notice to Proceed and Certificate of Occupancy

Submit the application with a site development plan showing roads, creeks, the building site and the proposed height of the structure, plus an elevation certificate; both are required for all new development. Plans go in duplicate, drawn to scale.

  • Notice to Proceed: once the plans show compliance, the Floodplain Administrator issues a Notice to Proceed with Construction. Starting work before it is a violation of the order.
  • Floor height: in mapped special flood hazard areas, the lowest floor of a home must be at least 24 inches above the base flood elevation; commercial buildings must meet the same height or be floodproofed under an engineer’s or architect’s certification.
  • Floodways: development in a regulatory floodway needs an engineer’s no-rise certification.
  • Large projects: subdivisions and parks over 50 lots or 5 acres must supply base flood elevations.
  • Completion: an as-built elevation certificate from a licensed surveyor or engineer, followed by a site inspection, leads to the county’s Certificate of Occupancy; occupying the building before it is issued violates the order.

Outside the special flood hazard area the permit is still required, and the order allows the permit to be waived for some non-residential outbuildings in the flood hazard area depending on their use. Variances are decided by the County Judge, with appeals to the Commissioners Court.
