Milam County issues no building permit for homes outside the cities, but rural land still needs a county development permit, a Health Department septic permit and, for commercial and larger apartment buildings, a Fire Marshal building permit.

Outside city limits, Milam County has no building code or building permit for houses. Rural projects go instead to Planning & Development (254-627-1760) for a development permit, $100 for a residential application, and to the Health Department for a septic permit from $410. Commercial establishments, public buildings and apartment buildings of four or more units need a building permit from the County Fire Marshal under the fire code adopted May 26, 2025. Cameron and Rockdale permit work inside their own limits.

What permits and approvals may be required?

A new house, barn or shop on rural land in Milam County does not get a county building permit or building inspection. These county approvals can still apply:

  • Development permit from Planning & Development before any work starts on a new structure, addition, manufactured home, fill, grading or drainage work; the application says no work of any kind may start until it is issued
  • On-site sewage facility (septic) permit from the Health Department before a system is built, altered or repaired
  • County road entrance (driveway) permit, approved on site by the precinct commissioner
  • Subdivision plat for dividing land, and County rules for RV parks and manufactured home rental communities
  • Pipeline crossing, road use and temporary water line permits for work in or across county roads

Fire Marshal building permits are priced from the ICC Building Valuation Data table: cost per square foot for the occupancy and construction type, times the floor area, times 0.002, plus a $500 base fee. The County’s own example is a 1,500 sq ft restaurant at $144.33 per sq ft, which comes to $932.99. The fee includes the first Certificate of Occupancy, which is then renewed each year with an annual fire inspection. Sprinkler systems add $350 per riser plus $0.50 per head, fire alarms $250 plus $0.50 per device, and kitchen hoods $200. Six steps for a Milam County filing

1. Check the town first

Inside Rockdale or Cameron, the city’s permit office handles the building permit, not the County.

2. Apply for the development permit

Send the Development Permit Application with a site plan to Planning & Development; the administrator decides whether the site lies in a flood hazard area and what else is needed.

3. Design the septic system

Have a registered sanitarian, engineer, licensed installer or site evaluator do the soil evaluation and planning materials, then file the septic application in the owner’s name.

4. Get the driveway approved

Meet the precinct commissioner on site; the commissioner’s office sets the culvert size within 7 days.

5. Commercial jobs: file with the Fire Marshal

Submit plans and fees through MilamCountyPermits.com; the code gives the Fire Marshal 30 days to issue or deny the permit.

6. Close out each permit

Collect the septic License to Operate, and for commercial buildings the Certificate of Occupancy, before use.

Inspections and project closeout

Septic: construction cannot begin until the Health Department issues an Authorization to Construct, which is valid for one year. After the system passes inspection, the owner receives a License to Operate. Owners of aerobic systems must keep a maintenance contract with a state-certified provider on file with the Health Department, and the provider must inspect at least every 4 months; failing either is a Class C misdemeanor with fines of up to $500 a day.

Flood plain: where a structure is in a flood hazard area, a registered engineer or licensed surveyor must submit as-built elevations before the County certifies compliance.

Commercial buildings: the Fire Marshal’s Office schedules its inspections through MilamCountyPermits.com. A failed fire inspection costs $65 to re-inspect, a temporary Certificate of Occupancy is $550 for 90 days, and inspections outside 8:00 a.m.–6:00 p.m. on weekdays need a written request 3 days ahead and cost $150 an hour, with a two-hour minimum.
