Jasper County issues no building permit, makes no building inspections and requires no certificate of occupancy outside its cities. What the county does regulate is the floodplain: any work or fill in a FEMA flood zone needs a Floodplain Permit from Emergency Management (409-994-2543), and new homes there must sit at least 2 feet above base flood elevation. Septic systems go to TCEQ, or to the Angelina & Neches River Authority near Sam Rayburn Reservoir.

What needs a permit in unincorporated Jasper County?

The County Judge’s office states that the Commissioners Court has passed no zoning rules except for the airport and floodplain areas, and that the county neither permits nor inspects buildings in unincorporated areas. That leaves a short list of approvals for rural land:

Septic systems in Jasper County

The county’s own letter on permit requirements sends septic permitting to TCEQ (409-898-3838); TCEQ lists no local authorized agent for the rest of Jasper County, so its Region 10 office in Beaumont issues those permits. The exception is the shoreline of Sam Rayburn Reservoir. There the Angelina & Neches River Authority (ANRA) is TCEQ’s authorized agent for a control zone that starts at the Corps of Engineers 179-foot elevation line and runs 2,000 feet inland, and a subdivision with any part inside the zone falls entirely under ANRA. TCEQ’s 2025 report shows ANRA issued 14 septic authorizations in Jasper County that year.

For an ANRA permit, a licensed site evaluator checks the soil, a registered sanitarian or professional engineer designs the system, and the packet goes to ANRA’s OSSF Department in Lufkin (936-632-7795). The permit to construct is good for one year, and the installer must book the final inspection at least 5 working days ahead. The county issues no electrical, plumbing or mechanical permits; inside Jasper, the City takes separate electrical, HVAC, plumbing and gas, generator and fire protection applications.

Starting a project on rural Jasper County land

1. Check the city limits

Inside Jasper, apply to the City’s Code Enforcement and Inspections Department; inside Kirbyville or Browndell, ask the city first.

2. Get a 911 address

Rural addresses come from SETRPC 911 Addressing at 409-347-1911, ext. 6102.

3. Look up the flood zone

Search the FEMA Flood Map Service Center, or ask Emergency Management, which keeps the county’s floodplain files, elevation certificates and map amendments.

4. Apply for a Floodplain Permit if mapped

Expect to supply an elevation certificate and, where the Floodplain Administrator asks, a flood study, before-and-after topographic survey or a FEMA map revision.

5. Permit the septic system

Hire a site evaluator and designer, then apply to TCEQ or, near Sam Rayburn, to ANRA before installation.

6. Plat any new lots

Dividing land so that any new tract is 10 acres or less needs a concept plan, preliminary plat and final plat approved by Commissioners Court.

Inspections, plats and penalties

The county makes no building inspections and issues no certificate of occupancy for rural homes. Septic systems are inspected by the permitting authority before they are covered. In a flood zone, the Floodplain Administrator approves a permit only after finding that the work will not harm neighboring property, reduce the watercourse’s flood capacity or create a hazard during floods. Under state law the county can sue in District Court to stop unpermitted floodplain work, and fines can reach $100 a day.

Subdivisions: the county’s rules (amended September 10, 2018) cover land outside the cities divided into two or more parts when any part is 10 acres or less; divisions among family members and by will are exempt. Six copies of the preliminary plat go to the County Engineer at least 30 days before the Commissioners Court meeting, and an approved preliminary plat lasts 18 months. Where lots will use private septic systems, percolation tests by an engineer or registered sanitarian go with the plat. New roads need a 50-foot right-of-way and a 22-foot paved surface, and the county holds a “no negative impact” policy on flood levels and downstream flows. Plats inside a city’s extraterritorial jurisdiction are approved by the city or the county as set by interlocal agreement.
