Building permits for property inside Brandon city limits come from the City’s Planning and Inspection Department (605-582-8987), which also reviews construction plans and inspects building and plumbing work. Brandon moved to the 2024 International Residential, Building and Existing Building Codes and the 2024 Uniform Plumbing Code in 2026, and anyone building or remodeling homes for others needs a City residential contractor’s licence ($100 a year).

What needs a building permit in Brandon?

Chapter 4-5 of the Brandon Municipal Code forbids an owner, contractor or builder to start any work that needs a permit before the permit is issued. The zoning regulations (Chapter 15-20) add that new development, a change of use, moving a structure in or out, and demolition all need a building permit from the City’s Zoning Administrator. The City’s Building Handbook asks for a separate permit for each building or structure.

Permit needed

  • Erecting, enlarging, altering, repairing, improving or converting a building or structure
  • Moving a building onto or off a lot
  • Demolition (a wrecking permit under Chapter 4-1-2)
  • A change of use
  • Temporary signs (separate sign permit)
  • Development in a mapped flood hazard area (floodplain development permit)

No permit (Building Handbook)

  • Retaining walls under 48 inches high
  • Non-commercial water tanks
  • Painting, papering, tiling, carpeting, cabinets and countertops
  • Prefabricated swimming pools less than 24 inches deep
  • Swings and other playground equipment
  • Window awnings, and window replacements with no size change
  • General landscaping

Exempt work must still meet the building code and the zoning rules. A residentially zoned lot may carry no more than two active building permits at the same time. Separately, state law (SDCL 11-10-15, 2026) bars the City from requiring a permit for the repair or substantially similar replacement of same-size doors and windows, downspouts, fascia, fence panels or posts, gutters, nonstructural siding and soffits on an owner-occupied detached single-family house.

Who issues building permits in Brandon?

The Planning and Inspection Department handles zoning questions, plats, sign approvals, variance and conditional use applications, home occupations, construction plan review, permit issuance, building and plumbing field inspections, nuisance code enforcement and the licensing of residential contractors. Paul J. Clarke, CPCU-CBO, is the City’s Building Official and Code Enforcement Officer.

Brandon applications, licences and boards

The building permit application itself is issued by the Zoning Administrator at the Planning and Inspection office. The City posts these related forms and licences:

  • Residential Building Contractor’s License (2026 form): required to build, enlarge, alter, repair or convert any one-, two- or three-family dwelling or an accessory building that needs a permit. Owners working on the home they live in (or will live in), landlords working on their own property, and builders of commercial buildings in a B-1 or higher district are exempt.
  • Variance Application ($375), heard by the Planning & Zoning Commission sitting as the Board of Adjustment. The form warns applicants not to discuss the request with Board members before the hearing.
  • Conditional Use, Re-zoning and Home Occupation Permit applications.
  • Temporary Sign Permit, approved by the Building Official.
  • Landscape Irrigation Contractor licence application (2026).

The Planning & Zoning Commission meets on the first and third Thursday of each month at 6:30 p.m. in the Council Chambers, 308 S. Main Avenue. Variance, conditional use and rezoning applications are obtained from the Inspections office.

Building permit fees in Brandon

Under section 15-20-2 of the zoning regulations, permit fees are set by City Council resolution, and the current schedule is kept by the Zoning Administrator (605-582-8987) rather than printed in the code. Fees are non-refundable, and the City takes no action on an application until they are paid. These charges are published:

The demolition bond under Chapter 4-1-2 is $5,000 for damage to property, $20,000 for injury to one person and $60,000 for injury to several people; a liability insurance policy for the same amounts can be filed instead. Before a wrecking permit is issued, the City must confirm that the sewer and water service lines have been disconnected to its specifications.

Plumbing, electrical and mechanical work in Brandon

Plumbing: Brandon is one of five South Dakota cities, with Aberdeen, Rapid City, Sioux Falls and Spearfish, that the state Plumbing Commission lists as doing their own plumbing inspections. The City’s plumbing inspector, a master plumber, handles plumbing plan review and inspections under the 2024 Uniform Plumbing Code with Brandon’s amendments. Ask the Planning and Inspection office for the plumbing permit and its fee.

Electrical: wiring is permitted and inspected by the South Dakota Electrical Commission, which the City’s inspection page links to. An owner wiring the home they live in needs the Commission’s homeowner permit before starting.

Mechanical, fuel gas and fire: the 2024 International Mechanical, Fuel Gas and Fire Codes and the 2023 National Electrical Code are adopted without local amendment, and Chapter 4-5 also adopts the latest NFPA Life Safety Code.

Before a certificate of occupancy is issued, tags or stickers on the main electrical box must show that rough-in and final plumbing and electrical inspections were passed. Inspectors from any agency must send the City copies of their reports within three days of each inspection.

What to submit with a Brandon permit application

Section 15-20-1 lists what makes an application complete:

Rather talk it over?

Call 1-855-478-4290 →
  • The City’s building permit application, completed by the landowner or the landowner’s representative
  • Any required attachments and the City fees
  • One copy of plans drawn to scale showing the shape and dimensions of the lot, the size and position of any existing buildings, and the location and dimensions of the new building or structural alteration
  • Anything else the Zoning Administrator asks for to check the project against the zoning code

The Zoning Administrator signs and returns a copy marked approved or disapproved and keeps a matching copy. A project that does not meet the zoning rules can only go ahead after a variance, a zoning amendment or a conditional use permit.

A contractor applying for the residential licence must pass the City’s code examination (a current Sioux Falls contractor licence is accepted instead), give a South Dakota contractor’s excise tax number, post a $10,000 compliance bond, and carry liability insurance of at least $100,000 or 10% of the job cost. Licences expire on December 31 each year.

How to get a Brandon building permit: 6 steps

1. Confirm the site is in the city

Unincorporated land around Brandon is permitted by Minnehaha County Planning and Zoning in Sioux Falls, not by the City.

2. Check zoning first

If the project breaks a setback or use rule, apply for a variance or conditional use and wait for the Planning & Zoning Commission hearing.

3. Line up a licensed builder

Hire a contractor on the City’s 2026 list of licensed residential builders, or apply as an owner building your own home.

4. Apply with scaled plans

Get the application from the Zoning Administrator and return it with the site plan, building plans and fees.

5. Arrange the trade permits

Get the plumbing permit from the City and the electrical permit from the South Dakota Electrical Commission.

6. Call for inspections

Book footing, framing and final inspections at 605-582-8987 and finish within the permit’s one-year life.

Brandon inspections and certificate of occupancy

Chapter 4-8 requires three structural inspections on every project: footing, framing before the framing is covered, and a final after the electrical and plumbing finals. Work must stay exposed until it is approved, and the City does not pay to uncover it.

  • Footing and foundation: after excavation, with forms, reinforcing steel and the concrete-encased electrode (Ufer ground) in place, before the pour. The Handbook sets the frost line for Brandon lots at 42 inches.
  • Framing: after the roof, framing, fire blocking and bracing are complete and rough electrical, plumbing and mechanical work is in place.
  • Electrical (state): meter socket, rough-in before the framing inspection, and final.
  • Plumbing: underground before backfill, rough-in before the framing inspection, and final.
  • Final: once the permitted work is complete and before anyone moves in.

A permit becomes void if the work is not finished within 365 days of issue. The Zoning Administrator can extend it once, by up to 180 days, on a written request showing circumstances beyond the permit holder’s control. The Building Official may grant a temporary certificate of occupancy for a safe part of a building, and the person who took out the permit is responsible for getting every inspection done.

Local Brandon rules worth knowing

Floodplain: the City’s Floodplain Regulations (Appendix A) require a development permit for work in special flood hazard areas, and the City Administrator acts as Floodplain Administrator.

Local code amendments: the codes are adopted “and amendments”, which are on file with the Building Inspector. The City’s Adopted Revisions page still posts its amendments to the 2021 editions and asks callers to contact the Building Department at 605-582-8987 for the full code.

New permit software: on October 5, 2026 the City Council approved a contract with GovWell for permit and plan review software, at $36,925 for the first year and $25,000 a year after that.

Building activity: the City’s permit history shows 463 permits in 2024, covering 48 single-family homes and 151 multi-family units.

South Dakota building code

South Dakota has no state-enforced building code: each city or county decides whether to adopt one. The state Electrical and Plumbing Commissions permit and inspect those trades, except in a few cities that run their own inspections. South Dakota rules
