Westerly, Rhode Island Building Permit Guide

To get a building permit in Westerly, confirm which office issues permits for the property’s address, then submit the application with your plans and required documents, pay the permit fees, and pass inspections before final approval. Alliance Permitting can prepare, file and track the permit for you and schedule the inspections.

Westerly’s Building Office, on the lower level of Town Hall at 45 Broad Street, issues building, electrical, plumbing, mechanical and demolition permits from online applications, and inspections are booked by phone.

In Westerly building, trade and demolition permits come from the Town’s Building Office, the Town’s code enforcement office, and every application is made online. Building, plumbing, mechanical and electrical permits share one valuation schedule, starting at $10 per $1,000 with a $50 minimum, plus a $10 e-permit application fee and a state levy. Houses, garages, decks, sheds and pools need zoning approval before the building permit is issued, and inspections must be requested by phone, never by email.

What requires a permit in Westerly?

The Building Office issues five permit types: building, electrical, plumbing, mechanical and demolition. Some building permits need zoning approval before they can be issued; the Town names single-family houses, garages, decks, sheds and pools.

Building Office permits

  • Electrical
  • Plumbing

  • Demolition

Zoning Office approvals

  • Zoning certificates
  • Sign permits
  • Commercial parking lots
  • Dimensional modifications
  • Zoning Board of Review applications

Sheds and other accessory buildings (Zoning Ordinance Section 260-66): no accessory structure may sit in a front or corner side yard. A single-story one under 16 ft high and no more than 144 sq ft may go within 6 ft of a side or rear lot line in any district. The reduced accessory setbacks apply only up to 550 sq ft, one story and 20 ft high; anything bigger must meet the full yard setbacks, and a structure within 6 ft of the house or connected to it counts as part of the house.

Fences and walls (Section 260-68): up to 6 ft high outside industrial districts, where 10 ft is allowed; barbed and razor wire are banned throughout the town.

What Westerly handles and what the state keeps

Westerly divides the Town’s part of a project between two offices at Town Hall. The Building Office issues the building, trade and demolition permits and inspects the work; the Zoning Office issues zoning certificates, sign permits and aquifer protection permits, checks uses and supports the Zoning Board. The Fire Department carries out residential smoke and carbon monoxide inspections and life safety inspections, booked through the same portal. State approvals stay separate: a CRMC assent for coastal work, RIDEM septic and freshwater wetlands permits, and contractor registration or trade licences, which the portal checks against the state’s own records.

Westerly building department: who handles permitting

The Building Office enforces the state building codes and makes routine daily inspections of work in progress. David Murphy is the Building Official, with an Alternate Building Official, and the Town’s electrical and plumbing inspectors enforce the state trade codes. Zoning is a separate office: the Zoning Official reviews applications for compliance with the Zoning Ordinance, and the Zoning Office handles zoning certificates, sign permits, commercial parking lots, dimensional modifications and Zoning Board of Review applications.

Westerly applications

All permit applications are submitted online through the Town’s OpenGov portal, reached from westerlyri.gov/permit. Every permit carries a $10 E-Permit Application Fee, and paying online adds a third-party processing fee. Zoning certificate requests go through the separate Zoning Application Portal, and the Zoning Office posts its 2026 Zoning Board application review deadlines and the Board’s rules and procedures. The Building Office publishes monthly reports of the permits it has issued.

For a house, garage, deck, shed or pool, get the zoning approval first; the Building Office will not issue those building permits without it.

Residential permits

For a house, zoning comes first in Westerly, and the Zoning Department section of the portal is organised around it: separate applications for an accessory structure, an addition to a structure (any increase in area or rebuild of a house or accessory building, decks included), new construction, an accessory dwelling unit and a home occupation. Under Code Section 260-29B the Zoning Official has 20 days after a complete application to issue the zoning certificate or explain what further approvals are needed. The building, electrical, plumbing, mechanical, solar and demolition applications then follow in the Building Department section, each able to carry a related fire plan review.

Commercial permits

Commercial, industrial, retail and other non-residential properties, and changes of use, start with the Zoning Office’s Verification of Use application. Signs and commercial parking lots are permitted by the Zoning Office, an aquifer protection permit has its own application, and a tent permit must be filed at least 14 days before the event. Commercial work pays the same valuation schedule as homes, but the state levy line on the Town page has no cap for commercial projects, and the Fire Department’s life safety inspections are requested in the portal.

Looking up a Westerly permit or record

The Building Office posts monthly reports of the permits it has issued, and the portal’s Search for Records finds individual permits. Formal requests under the Access to Public Records Act go in writing to the Clerk’s Department on the first floor of Town Hall, 8:30 a.m. to 4:30 p.m. on weekdays, or by email or fax through the Town Clerk as public records officer (401-348-2505). Copies cost $0.15 a page, search and retrieval after the first hour costs $15 an hour, and the Town has 10 business days to respond, extendable by 20 for good cause. No written form is needed for records available under the Administrative Procedures Act or for documents already prepared for, or readily available to, the public.

Westerly permit fees

One schedule covers building, plumbing, mechanical and electrical permits. It is the Westerly schedule in the state fee regulation (510-RICR-00-00-21), last changed at the Town’s request in an amendment effective December 10, 2023.

Westerly permit fees (building, plumbing, mechanical, electrical)
ItemFee
Project value $1 to $10,000$10 per $1,000, minimum $50
Project value $10,001 to $50,000$100 plus $8 per $1,000 over $10,000
Project value $50,001 and up$420 plus $6 per $1,000 over $50,000
E-Permit Application Fee$10 on every permit
State levy (R.I. Gen. Laws § 23-27.3-108.2)0.1% of the construction cost per permit, at most $50 per permit for a one- or two-family dwelling; the Building Office page describes it as 0.2% capped at $100 for residential work and 0.1% with no cap for commercial
Paying onlineThird-party processing fee added

The Building Office page words the first band as a $50 minimum plus $10 per $1,000 over $5,000, which gives the same result. As an example, a $20,000 deck on a house costs $100 plus 10 × $8, or $180, plus the $10 e-permit fee, $190 in all before the state levy. At the statute’s 0.1% the levy is $20; the Town page’s 0.2% rate would make it $40.

Electrical, plumbing and mechanical permits in Westerly

Electrical, plumbing and mechanical permits are issued by the Building Office on the same online system and valuation schedule as building permits, each with its own $10 e-permit fee. The Town’s electrical and plumbing inspectors enforce the state codes for their trades, and electrical, plumbing and mechanical inspections are scheduled by calling the office.

Who may pull trade permits

Westerly’s portal is linked to the state’s licensing and registration records. When a contractor applies and the “license active” box comes up unchecked, the Building Department explains that the contractor’s insurance information has to be updated with the state: save the application as a draft and call the Contractors’ Registration Board (401-921-1590) or, for a licensed trade, the Department of Labor and Training (401-462-8580). The Department of Labor and Training licenses electricians, plumbers and mechanical trades, and the Contractors’ Registration and Licensing Board registers builders and subcontractors; R.I. Gen. Laws § 5-65-3 bars a building permit for an unregistered contractor who needs registration.

Review, corrections and what causes delay

Zoning comes first in Westerly: the Zoning Official has 20 days from a complete zoning application to issue the certificate or set out what else is needed, and houses, garages, decks, sheds and pools cannot get a building permit before that. The portal’s zoning section notes that staff messages, payment requests, document uploads and the final certificate arrive by email from noreply@opengov.com. A contractor whose state licence or registration shows as inactive in the portal cannot finish the application until the state record is updated, and every inspection must still be phoned in.

Westerly inspections

Call the Building Office at 401-348-2547 to schedule every inspection, including electrical, plumbing and mechanical ones. The office says plainly that inspections cannot be requested by email. Inspectors make routine daily site visits while work is in progress to check compliance with the state codes, and the Building Official and staff are available to answer questions about a project.

Westerly coastal, flood and septic rules

Flood zones: Westerly takes part in the National Flood Insurance Program; its current FEMA flood maps took effect on April 3, 2020.

Coastal work: the Coastal Resources Management Council permits work in the coastal zone, and that approval is separate from the Town’s permits.

Septic systems: where a lot has no sewer, the septic (OWTS) permit comes from RIDEM, which typically reviews new construction and alteration designs in 3 weeks and repairs in 1 to 2 weeks. Under the Zoning Ordinance, septic systems and fences are not treated as structures for zoning purposes.

Wetlands: RIDEM permits work in or near freshwater wetlands under the Freshwater Wetlands Rules in effect since July 1, 2022.

Building code in Westerly

The Building Office enforces the Rhode Island State Building Code, the International Codes with Rhode Island amendments, and points applicants to the ICC’s digital copy. Since December 1, 2025 that means the 2021 International Codes, the 2023 National Electrical Code and the 2024 energy code.

Rhode Island has one state building code, kept by the State Building Code Office and enforced by each city or town’s building official; there is no county layer, and appeals go first to the town’s board of appeals, then to the state Building Code Board of Standards and Appeals. Rhode Island rules
