Payne County does not issue building permits: the state building code commission lists it as a non-issuing county. For land outside the towns, the county asks for a floodplain development application (Form FP-4) before houses, barns, other buildings, fill or grading, so that its Floodplain Administrator can decide whether the site is in a mapped special flood hazard area, where the county’s floodplain regulations and permit apply. Inside Stillwater, building permits come from the City’s Development Services department.

Who handles permits in Payne County?

The Payne County Floodplain Board, appointed by the county commissioners, adopts the floodplain rules, and its Floodplain Administrator reviews and approves development permits for unincorporated land. The administrator works from the Commissioners’ Office in the County Administration Building. The commissioners themselves approve road crossing and access permits for the county road system. On-site sewage systems are permitted by the Oklahoma Department of Environmental Quality, and trade licences come from the Construction Industries Board.

What the floodplain permit needs

Form FP-4 asks for the applicant’s contact details, the type and purpose of the development, its location (GPS coordinates, an address, or section, township and range) and a sketch showing where it sits in the section. The board’s letter to owners says the administrator first determines whether the site is in a defined floodplain; if it is in or near one, more information such as elevation data may be needed before the permit is issued.

Under the county regulations, plans in a special flood hazard area show the location, dimensions and elevations of the work, the elevation of the lowest floor, and any change to a watercourse. A house there must have its lowest floor, including any basement, at least 2 feet above the base flood elevation, certified by a registered engineer, architect or land surveyor; a nonresidential building must be raised the same amount or floodproofed. The county posts FEMA’s 2023 elevation certificate for this.

Building in rural Payne County

1. Find out whether you are in a town

Inside Stillwater, Cushing, Perkins, Drumright or Yale, apply to that city instead of the county.

2. File Form FP-4

Send it to the Floodplain Administrator at 315 W. 6th Ave., Suite 203, or by email; forms are also kept at the District 1 and District 3 county barns.

3. Wait for the flood determination

The administrator marks whether the development is in a special flood hazard area and asks for elevation data if it is.

4. Arrange septic and utilities

Rural homes on septic need a DEQ permit for the on-site system; utility lines under county roads need a road crossing permit.

5. Hire licensed trades

The electrician, plumber and heat-and-air contractor need Construction Industries Board licences; the county issues no trade permits.

Inspections

Payne County has no building inspection program for unincorporated land. Work in the county right-of-way is subject to inspection and approval by the county commissioners, and for an industrial access the county photographs the road before and after construction and releases the bond after final inspection.

Local details

Oil and gas: the floodplain regulations require a floodplain development permit to drill an oil or gas well in a special flood hazard area, with production equipment raised to or floodproofed to the base flood elevation.

Farming: the floodplain permit does not apply to normal farming practices or improvements such as terraces and farm ponds.

Rule review: the Floodplain Board’s August 13, 2026 agenda included a possible action on a zero-rise regulation; the posted regulations are still the ones the board adopted on August 11, 2016.

Road crossings: under the 2026 permits, a service line must be buried at least 5 feet below the flow line of the right-of-way and a transmission line at least 12 feet; poly lines must be cased in steel, and paved roads must be bored rather than trenched.
