What requires a permit in Avery County?

The county asks anyone planning to build any type of structure to visit the Inspections office first. Its published applications cover:

Who handles permitting in Avery County?

The Inspections Department, led by Director Allison Kidd, reviews permits and inspects construction at set stages. The Planning Department, which shares the department’s phone and mailing address, approves subdivisions and commercial site plans, enforces the county ordinances and reviews every survey plat before it can be recorded.

  • Banner Elk and Sugar Mountain: the county building permit application asks for a zoning permit from Banner Elk or the Village of Sugar Mountain (the form also lists Land Harbor and GGCC), so the town zones and the county issues the building permit. Banner Elk Town Hall is at 200 Park Avenue (828-898-5398); Sugar Mountain Village Hall is at 251 Dick Trundy Lane (828-898-9292).
  • Beech Mountain (mostly in Watauga County): the town’s own Planning & Inspections Department enforces the state building code and issues permits through its Edmunds portal (828-387-4236).
  • Seven Devils (mostly in Watauga County): the town’s Zoning Administrator issues zoning permits for the town and its ETJ (828-963-5343, ext. 104); the town’s pages do not say who inspects construction, so ask the town.
  • Newland: the town code (Chapter 90) assigns all permits and state code enforcement inside the town limits to Avery County officials; the Town itself charges $25 for a permanent sign permit. Town Hall is 828-733-2023.
  • Elk Park: the town ordinances posted online have no zoning or building chapter, but a new water or sewer connection needs a Town permit. Town Hall is 828-733-9573.
  • Crossnore and Grandfather Village: no town building or zoning permit pages were found, and the county pages do not name exceptions for them.

Trade permits and contractor forms

Electrical, plumbing and mechanical permits each have their own county application. When a contractor files a building permit, the packet includes a licence check and regulation sheet for the electrical, plumbing and HVAC contractors, each sworn before a notary. What the Avery County application asks for

  • Owner, project address, township, parcel ID and whether the lot is in a subdivision
  • Projected cost, electrical service size, heating, air conditioning and fireplaces
  • Bedrooms, bathrooms, finished and unfinished square footage by floor, decks and porches, and building height
  • Licence numbers for the building, electrical, plumbing, mechanical and alarm contractors
  • Septic permit number from the health department, or public sewer
  • The required zoning permit and whether the site is in a floodplain
  • A sworn certification of licence status; an owner-builder states the house is not a speculative build and will live there for at least a year
  • A workers’ compensation affidavit and a single homesite grading affidavit

Log homes need plans sealed by a North Carolina engineer and a REScheck or MECcheck insulation sheet. Construction in the county’s 120–130 mph wind zones must meet the high wind zone chapter of the state residential code. Commercial projects add Appendix B and, where needed, a commercial site plan.

How to apply for an Avery County building permit

1. Find out which town governs the lot

Beech Mountain lots go to the town. Banner Elk and Sugar Mountain lots need the town or village zoning permit first; Sugar Mountain asks for 30 days to process it.

2. Get the septic permit

Write its number on the building application.

3. Check grading and floodplain

Grading near streams or over an acre, and floodplain sites, need Planning Department permits.

4. Complete the owner or contractor packet

Use the homeowner or contractor application from the Permit Forms page, with notarized licence and workers’ compensation forms.

5. File at 200 Montezuma Street

Submit the packet and pay the building, recovery and amperage fees.

6. Start within 6 months

The permit expires if work does not start within 6 months or stops for 12 months.

Inspections in Avery County

Call 828-733-8204 to schedule an inspection. A job site must have a portable toilet on site or a bathroom within 400 feet; otherwise the county will not provide temporary electrical service. Central-station alarm systems need an alarm user permit, and the installer must submit an installation certificate before the Certificate of Occupancy is issued.

Mountain rules in Avery County

Park models: a park model cannot be used as a permanent home (no more than 180 consecutive days in one place) unless it is labeled as a HUD mobile home or a modular home. Living space is capped at 400 sq ft, the unit must stay ready to tow with no permanent plumbing, mechanical or electrical connections, it must be heated by gas, and its footings go below the county’s 18-inch frost line.
