The Town of Lewisboro Building Department, 892 Route 35, Cross River (914-763-3060), issues building permits and certificates of occupancy or compliance throughout the town, which contains no incorporated village. You can file hard copies or upload the same package to City Squared. Under the fee schedule effective February 24, 2025, a residential job pays $102 in filing and records fees, $10 per $1,000 of estimated cost for the permit and the same again for the certificate, and the permit fee already covers plumbing, heating and mechanical work.
What requires a building permit in Lewisboro?
Section 92-4A requires a permit for any work governed by the Uniform Code or Energy Code, and names retaining walls, swimming pools, boundary walls and fences, signs, poles, radio masts and solid-fuel stoves, chimneys and flues. The single building, mechanical and minor-work application lists what the department sees most often.
Lewisboro permit needed
- New buildings, additions, garages and alterations
- Kitchen and bath renovations, insulation, roofing
- Decks, patios and terraces, retaining walls
- Fences, sheds over 64 sq ft, pools
- Boilers, furnaces, HVAC, generators
- Fireplaces and wood stoves
- Oil and propane tanks, solar panels
- Electrical work, fire alarms and sprinklers
- Signs, tents, demolition, change of occupancy
Exempt under Section 92-4B
- Sheds, playhouses and similar one-story buildings of 64 sq ft or less at one- or two-family homes
- Swings and playground equipment

- Wall-mounted window awnings
- Partitions under 5 feet 9 inches; painting, tiling, carpeting
- Portable appliances and like-for-like equipment swaps

With the limit at 64 sq ft, most garden sheds need a permit. Work finished without one is legalized at twice the building permit fee, with a $250 minimum on the application form.
What Lewisboro decides and what the state sets
The Uniform Code and Energy Code set the construction standards. Lewisboro’s Chapter 92 (Local Law 2 of 2006, last amended by Local Law 7 of 2025) sets the permit terms, inspections and fees, and other chapters add local land-use rules: wetlands and watercourses (Chapter 217, rewritten in April 2025), flood damage prevention (Chapter 126), tree preservation (Chapter 203), sewers and septic upkeep (Chapter 183) and zoning (Chapter 220). Any stricter construction standard would need the state Code Council’s approval.
Lewisboro building department: who handles permitting
Lewisboro has no villages, so the town Building Department, under Building Inspector Kevin Kelly, covers every property; the county’s list of local building departments gives its mailing address as P.O. Box 725, Cross River, NY 10518. The same office takes zoning matters, and the Building Inspector refers applications to the Planning Board, the Zoning Board of Appeals or the Architecture and Community Appearance Review Council (ACARC) when a project needs them.

Lewisboro permit types and filing rules
Residential permits
One building, mechanical and minor work application covers everything from a new house to a boiler swap. Bring hard copies or upload each item to City Squared. The package holds the signed application, the nonrefundable permit and certificate fees, one site plan showing setbacks and the location of septic systems and wells, equipment cut sheets (stoves, flues, generators, LP and oil tanks, water heaters, HVAC) and, where an agent files, a letter of authorization from the owner and any management company.
Structural drawings stamped by a New York architect or engineer are required for every deck, every structural change and every project over $20,000. Round the estimated cost up to the next $1,000; under Section 92-19 it must include mechanical, plumbing, heating, air conditioning and electrical work, and if the final cost runs higher, more fee can be charged before the certificate issues.
Since October 1, 2024 every application must also include the receipt from the most recent septic tank pump-out or service visit. Chapter 183 requires owners in the watershed who rely on septic to have the tank pumped and inspected by a county-licensed septage collector at least once every five years and to keep the report for six years, and no certificate is issued until compliance is shown.

Commercial permits
Commercial projects use the same form at $15 per $1,000 for both the permit and the certificate. Commercial kitchen hoods, fire alarms and sprinkler systems are listed on the form, tents need a temporary permit ($102 plus $20 per $1,000) and places that need a fire code operating permit pay $150. A pre-dated commercial certificate under zoning Section 220-76C costs $360.
For tenant improvements and new commercial builds, Alliance handles commercial permit expediting through issuance. More on this: commercial building permits explained.

- Wetlands: Chapter 217 protects a 150-foot buffer around wetlands and watercourses; the Planning Board or the Town Wetland Inspector decides permits, depending on the work.
- Zoning: setbacks follow the district (table below); front setbacks are measured both from the street center line and from the front property line.
- Environmental questionnaire: $50 when the department asks for one.
- Septic and wells: new or replacement systems are designed to the county’s 2022 rules and permitted by the Westchester County Health Department.
- Blasting: a $500 permit and proof of at least $1,000,000 of liability insurance naming the town.
| District | Minimum lot | Front (center line / street line) | Side | Rear |
|---|---|---|---|---|
| R-4A | 4 acres | 75 ft / 50 ft | 50 ft | 50 ft |
| R-2A | 2 acres | 75 ft / 50 ft | 40 ft | 50 ft |
| R-1A | 1 acre | 65 ft / 40 ft | 30 ft | 40 ft |
| R-1/2A | 1/2 acre | 55 ft / 30 ft | 15 ft | 30 ft |
| R-1/4A | 1/4 acre | 50 ft / 25 ft | 12 ft | 25 ft |
| R2F | 10,000 or 7,500 sq ft | 55 ft / 30 ft or 50 ft / 25 ft | 10 ft or 8 ft | 20 ft |
On lots in the R-1/2A district or smaller, an accessory building no taller than 12 feet may sit 5 feet from any line in the rear yard; anything that misses a setback goes to the Zoning Board of Appeals before a permit can issue.
Lewisboro building permit fees
Section 92-16 leaves fees to the Town Board. The Building and Zoning Department fee schedule has been in effect since February 24, 2025, and the application form splits the $102 into a $100 filing fee and a $2 records management fee.

Trade permits and who may pull them
Electrical, plumbing and mechanical. Trade work goes on the same building, mechanical and minor-work application: the building permit fee includes plumbing, heating and mechanical work, and electrical work is a box on the form. The plumber and electrician must each be licensed by Westchester County and supply a copy of the county photo license, because the department will not look licenses up for you.

The town’s electrical agencies page sends owners to Statewide Inspection Services, Better Homes Electrical Inspection Services, New York Electrical Inspection Services or Tri-State Inspection Agency. Westchester County requires electrical inspectors to hold a county license unless they work for a government, and posts its own list of qualifying agencies.
Contractors. A general contractor needs a Westchester County home improvement license, a copy goes with every application, a pending license needs written proof from the county, and names and addresses on licenses and insurance must match. The county Department of Consumer Protection (148 Martine Avenue, Room 407, White Plains; 914-995-2211 for home improvement licensing) has charged a $750 application fee since January 1, 2026.
Insurance. Workers’ compensation (C-105.2 or U-26.3), disability (DB-120.1 or DB-155) and liability certificates must name the Town of Lewisboro, 892 Route 35, as certificate holder; ACORD forms are refused. If there is no general contractor, or the contractor files a CE-200 exemption, every mechanical trade must file its own certificates.
How to apply for a Lewisboro building permit
Check the district’s lot area and setbacks and whether the work sits in a wetland buffer.
Find the latest septic pump-out or service report, or book one with a county-licensed septage hauler.
Signed application, site plan, stamped plans where required, cut sheets, license and insurance copies.
Deliver hard copies to 892 Route 35 or upload everything to City Squared, with the fees.
Go before the Planning Board, ZBA or ACARC if the Building Inspector refers the application.
Post the permit on site and begin work within three months of issue.
Review, corrections and what causes delay
Missing county license copies, ACORD insurance forms and a missing pump-out receipt are the items the form stresses. A change to approved plans costs $500 for review. Under Section 92-4I a permit becomes invalid if work has not begun within three months and expires 36 months after issue, with 12-month renewals available; the code governs, and the 18 months still printed on the application’s signature page is only a noted difference. Work under a permit is limited to 7 am to 7 pm, Monday to Saturday, with no Sunday work except in an emergency.

The permit holder must call the Building Department at 914-763-3060 for every required inspection; none are scheduled until the permit has been issued and posted. Section 92-5 lists the stages: the site before the permit, footings and foundation, slab preparation, framing, building systems including underground and rough-in work, fire-resistant construction and penetrations, solid-fuel appliances and chimneys, energy code items and a final. A failed or missed inspection costs $100.
When the work passes, the department issues a certificate of occupancy or compliance, paid for when you applied. It will not issue one without the septic pump-out record and, under Section 92-7, any required special-inspection report and flood hazard certification. Occupying a building before the certificate costs $100 a day.
New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
