Building permits in the Town of Gates are issued by the town’s Building Department, which shares a department with Public Works at 1605 Buffalo Road and is reached through the town line, 585-247-6100. Under the schedule adopted January 5, 2026, a new one- or two-family house costs $0.40 per square foot plus a $250 certificate of occupancy, and work started without a permit is charged four times the fee plus $200.

What requires a building permit in Gates?

The department lists the permits it issues as new buildings, additions and alterations, decks, pools and signs, and the January 2026 fee schedule shows the full range of residential work the town prices.

Residential permits

  • New one- and two-family homes and additions
  • Alterations and remodeling, priced by project value
  • Decks, gazebos and porches, including replacing guards, stairs or decking
  • Sheds, garages and carports
  • Fences (required since 2006 for new or replaced fences)
  • Above-ground and in-ground pools, hot tubs and pool heaters
  • Standby generators and roof-mounted solar
  • Re-roofing, foundations and demolition
  • Miscellaneous electrical, mechanical and plumbing work
  • Fill, driveways in the town right-of-way and flood plain development

Commercial and other permits

  • New commercial or industrial buildings and alterations
  • Signs, refacings and temporary graphics
  • Cell towers and small cell facilities
  • Fire Marshal construction permits: fire alarm, fire-extinguishing, standpipe and fire pump systems, and tanks
  • Fire Marshal operating permits for places of assembly and hazardous uses
  • Rental property permits and short-term rental permits
  • Temporary site trailers and storage
  • Elevator inspection certificates

The code makes one allowance for owners doing plumbing: in a single-family home that is not a rental, the homeowner may replace fixtures or appliances with similar ones without a permit; relocating them takes a permit and inspection. Owners may continue to use a fence built before the 2006 permit rule until it is changed or replaced.

What the town decides and what the state sets

Under Chapter 70 of the Town Code, Gates adopts the New York Uniform Code and splits enforcement between its Building Inspector and its Fire Marshal; the code’s technical requirements are the state’s. Gates controls what sits around them: the zoning setbacks in Chapter 190, fence, shed and pool placement, plumber registration, the licensing of electrical inspection agencies, flood damage prevention in Chapter 100, rental permits and the Town Board’s fee schedule.

Gates building department: who handles permitting

The Building Department reviews every plan for building code and zoning compliance before a permit is issued, inspects the work and issues compliance certificates. It works with the town’s contracted engineering firm, the Fire Marshal and the code enforcement officer, runs Planning and Zoning Board intake, coordinates Monroe County Home Improvement Program grants and keeps the town’s conditional use permits on their yearly renewal. A part-time Building Inspector reviews building plans and performs the required inspections. Gates has no incorporated village, so the department serves the whole town.

Permit types and how to file them

Residential permits

Residential jobs use the town’s general Building Permit Application from the Forms & Permits page, with a separate Plumbing Permit Application and Demolition Permit form. The application asks who owns the property (as listed on the deed), who is applying (an applicant who is not the owner must attach the owner’s written permission) and who is doing the work. An owner, friend or family member doing the work files a CE-200 exemption; a contractor files general liability and workers’ compensation certificates. Every application needs drawings or photos and specifications of the project and a survey map marked with distances to the lot lines and the house.

The town’s guideline sheets set the placement rules. Sheds, generators and above-ground pools must keep out of the front setback (35 feet from a town road, 50 feet from a state or county road), stay 5 feet from rear lines and 7, 8 or 10 feet from side lines in the R-1-8, R-1-11 and R-1-15 districts, and avoid easements unless the Director of Public Works approves an easement waiver. Sheds may be 15 feet tall to the midpoint of the roof. Fences may be 6 feet high, need at least one gate for first responders and must keep their decorative side facing out. Above-ground pools need a pool alarm, 15 feet from any structure with a foundation, 10 feet from overhead electric lines and 20 feet from a well or septic system. A gas generator needs RG&E’s appliance inventory sheet and must be 5 feet from openings in the house.

Commercial permits

A new business follows the town’s New Business Occupant Checklist: confirm the zoning district with the Building Department, then get any conditional use permit from the Town Board or use variance from the Zoning Board before the property is rented or sold, check for open violations with code enforcement, and confirm with the Building Inspector that the business fits the building’s occupancy classification and certificate of occupancy. Commercial alterations are priced on the alteration schedule by value, and fire alarm, fire-extinguishing, standpipe and tank work also needs a Fire Marshal construction permit ($200 each).

What comes before the building permit

  • Zoning Board of Appeals, meeting on the second Monday of each month, for setback, fence and other variances ($150 area variance, $300 use variance); the town notifies applicants of their hearing date.
  • Planning Board for site plans ($600 preliminary, $400 final), subdivisions and concept reviews ($250).
  • Town Board for conditional use permits ($300 with public hearing) and rezoning.
  • Flood plain development permit ($200, waived with site plan approval) in mapped flood areas; Gates is in the National Flood Insurance Program with flood maps dated August 28, 2008, and its generator sheet asks for equipment at the design flood elevation plus 2 feet of freeboard.
  • Right-of-way permit under Chapter 158 for a driveway ($100) or utility work in a town road.

Gates permit fees

The Department of Public Works Permit, Inspection and Application Fee Schedule was adopted by the Town Board on January 5, 2026. It is newer than some guideline sheets still posted (the 2024 generator sheet shows $50 and the plumbing application shows $40), and the adopted schedule’s figures apply.

For example, a new 2,000 sq ft house is $800 at $0.40 per sq ft, plus the $250 certificate of occupancy, a total of $1,050 before plumbing fixtures and any right-of-way or sewer charges. Rental properties need a $250 rental permit with a three-year certificate of compliance for a single-family rental, and short-term rentals a $125 permit.

Trade permits and who may pull them

Electrical. Under Chapter 87, no wiring may be installed or altered until an application for inspection has been filed with an electrical inspection agency licensed by the Town Board; the license runs to December 31 each year and the agency, not the town, charges for inspections. The town’s approved list is Commonwealth Electrical Services (585-624-2380), Middle Department Inspection Agency (585-454-5191) and New York Electrical Inspection Agency (585-436-4460). The agency issues the temporary certificate to the utility for energizing and sends the final certificate of compliance to the Building Department. The town code’s chapter list has no electrician licensing chapter; the $50 miscellaneous electrical permit covers stand-alone electrical jobs.

Plumbing. Chapter 143 bars anyone from plumbing in Gates without registering and holding an annual license from the Town of Gates, issued through the Town Clerk on proof of liability insurance naming the town plus workers’ compensation and disability coverage. Licenses expire on December 31, and a registration lapses after five years without a license. Backflow devices need a plumbing permit and a Gates-registered plumber, and plans needing Monroe County Water Authority approval go there before the county health department.

Fire protection. The Fire Marshal enforces the fire parts of the Uniform Code jointly with the Building Inspector and issues the construction permits for fire systems, chimneys and fireplace relines, solid-fuel appliances and propane installations.

Septic. Onsite wastewater systems are permitted by the Monroe County Department of Public Health on a design professional’s plan.

How to apply for a Gates building permit

1. Confirm zoning and setbacks

Check the zoning map and the town’s guideline sheet for your project; call the Planning Assistant if you need a variance.

2. Prepare the survey

Draw the project on the survey map with distances to the house and every lot line.

3. Collect insurance

Get the contractor’s liability and workers’ compensation certificates, or a CE-200 if you or a friend are doing the work.

4. Complete the forms

Fill in the Building Permit Application, with the plumbing or demolition form and an easement waiver where needed.

5. Submit and pay

Return the package to the department at 1605 Buffalo Road and pay the fee on the January 2026 schedule.

6. Build and pass inspections

Schedule the inspections the inspector lists and the electrical agency’s inspection, then obtain the certificate.

Review, corrections and what causes delay

The department does not publish a review time, and its forms flag what an application must not lack: a survey without distances to lot lines, missing insurance or CE-200 forms, an application filed by someone other than the owner without written permission, and a structure that needs a ZBA variance. A pool deck must also meet the 48-inch barrier and gate rules on the town’s deck sheet, including outward-opening, self-closing gates.

Gates inspections and certificates

Inspections are carried out by the town’s Building Inspector at the stages listed for the permit, with electrical work inspected separately by the agency you hired. Contact the inspector with questions about the sequence for your job (585-429-8241, or the town line, extension 241). A re-inspection or an inspection outside normal hours costs $200 each.

The process ends with a certificate of occupancy for new buildings ($250 residential, $400 commercial) or a compliance certificate for other work. A new tenant inspection for a business costs $100 and is credited toward later permits. Rental properties need their own rental permit and inspection, using the Rental Property Inspection Checklist on the forms page.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

Gates permit FAQ

How much is a building permit for a new house in Gates?

$0.40 per square foot plus a $250 certificate of occupancy, under the fee schedule adopted January 5, 2026; a 2,000 sq ft house comes to $1,050 before plumbing and other charges.

Do I need a permit for a fence in Gates?

Yes, for any new or replaced fence ($75). Residential fences can be 6 feet high, must have at least one gate and cannot sit in the front setback.

Do I need a permit for a shed?

Yes. A shed up to 144 sq ft is $100, one between 144 and 200 sq ft is $175, and larger ones are treated as new construction.

Who inspects electrical work in Gates?

A Town Board-licensed agency: Commonwealth Electrical Services, Middle Department Inspection Agency or New York Electrical Inspection Agency.

Can I do my own plumbing?

Plumbing in Gates must be done by a plumber registered and licensed with the town. In a single-family home that is not a rental, the homeowner may replace fixtures with similar ones without a permit, and relocations need a permit and inspection.

When does the Gates Zoning Board of Appeals meet?

On the second Monday of every month; call the Planning Assistant at 585-429-8243 for the filing cut-off.

How do I get a copy of an old permit or certificate?

File a Freedom of Information request with the Town Clerk; zoning compliance letters ($75) are requested from the Building Department instead.

Permit search and official resources

The town’s FOIL page names certificates of occupancy, permits and other property records among the records it releases: submit the online form or a written request to the Town Clerk, who acknowledges it within five business days. For a sale or refinance, order a zoning compliance letter from the Building Department rather than through FOIL.

Inspections are where schedules slip.
