Building in rural Otoe County takes two approvals: a county zoning permit from the Zoning Administrator at 1021 Central Avenue in Nebraska City, and a building permit on the joint “Nebraska City/Otoe County” application, which goes to the Building Inspector at 1409 Central Avenue and cites the 2018 International Building and Residential Codes. Allow at least seven business days for each, and expect a septic design and percolation test before a house is approved.
Who issues permits in Otoe County?
The county zoning regulations cover all of Otoe County except the areas where a city or village has been granted jurisdiction, and they require a zoning permit from the Zoning Administrator before any excavation, construction, alteration or move of a building. Dan Thomson, the County Surveyor, serves as Zoning Administrator.
Nebraska City’s Building & Zoning office takes building permit applications for its city and two-mile area and, on the same joint form, for property elsewhere in Otoe County; outside the two-mile area the county zoning permit must be filed as well. The county’s own zoning permit form states that Otoe County has not adopted a building code of its own.

What needs a permit?
County zoning permit: new construction, alterations or enlargements, moving a house or building, double-wide and single-wide manufactured homes, conversions of use, and septic systems. A temporary zoning permit, for up to six months, covers buildings needed during construction.
Building permit: the Nebraska City/Otoe County form covers new structures, additions, remodels, repairs and replacements, fences, garages and storage sheds, decks and porches and pole buildings. Nebraska City’s office lists pools 36 inches deep or more and fences and retaining walls over 4 feet as needing a permit, and shingling, residing, painting and pools under 24 inches as not needing one.

- Building Permit Application – Nebraska City & Otoe County (updated October 28, 2025), listing the structure, areas, value and the architect, plumber, electrician and heating contractor.
- County Utilities Application, posted with the other two forms on Nebraska City’s Permits & Licenses page.
Commercial projects also send plans to the State Fire Marshal’s office.
Fees and timing
The joint form says all fees are due when the application is made, while Nebraska City’s web page says to pay after approval; either way the payment is a deposit for code compliance and inspections plus the permit fee, by cash, check or card. Nebraska City’s office says the deposit refund is processed after the final inspection, once the City Council approves it. Any engineering charges for drainage review or extra plan review ordered by the Building Inspector are added to the permit.
The county zoning permit must be filed at least seven days before the Zoning Administrator acts on it, and the zoning regulations require a written decision within 15 days of accepting the application. The 2025 zoning form asks that work start within 90 days of approval and finish within two years; the 2016 zoning regulations say a permit expires after one year if the work is not complete, unless extended in writing.
Electrical and septic
Electrical: Otoe County is not on the State Electrical Division’s list of local electrical inspection programs, and electrical permits in the county’s area come from the Division.
Rather talk it over?
Call 1-855-478-4290 →Septic: any dwelling or business producing wastewater needs an onsite treatment system evaluated by a professional engineer, registered environmental health specialist, layout specialist or licensed installer. Before a building and zoning permit is issued, the building inspection department requires a percolation test, a septic or lagoon design, and a scaled drawing that meets the state’s Title 124 rules. Section 3.35 of the zoning regulations keeps absorption fields at least 25 feet from adjacent property lines.
Site plan checklist (county zoning permit)
- Location and size of the proposed building or addition
- Adjoining roads and the distance from each road centerline to the building
- Distances to property lines of other owners within 300 feet, and to any livestock feeding operation within 4 miles
- Other buildings within 300 feet
- Well and septic locations and the distance between them
- Rivers or streams within 300 feet, and the driveway
- For commercial, industrial or public uses: parking, loading areas and signs
Dimensions must come from an actual survey, and the building must be staked on the ground before work starts. The zoning office also checks floodplain status (first floor at least one foot above the 100-year flood), wellhead protection areas and any conditional use approval.
