What requires a building permit in Holbrook?

Holbrook’s application asks you to tick whether you will build, alter, demolish or move a structure, and the permit must be in hand before work begins. The town’s fee schedule shows the range of jobs the department prices separately, from additions and solar panels to siding and pools.

Permit needed

  • New one- and two-family homes and larger buildings
  • Additions and alterations
  • Solar panels (with an electrical permit first)
  • Siding (vinyl siding also needs an electrical permit)
  • Above-ground and in-ground pools (electrical permit first)
  • Mechanical and sheet metal work
  • Demolition and moving a building
  • Signs

Usually no building permit

  • Ordinary repairs and the other items on the 780 CMR 105.2 exempt list

For solar, siding and pools, the fee schedule says an electrical permit must be filed before the building permit is issued, so line up the electrician before you apply. Pools also have to meet the town’s swimming pool by-law: at least 10 feet from side and rear lines, 25 feet from the front (or the street setback), and an enclosure at least 5 feet high with self-latching gates.

What Holbrook decides and what the state holds

Plans are reviewed under 780 CMR, the 10th edition of the State Building Code issued by the Board of Building Regulations and Standards, which became the only edition accepted after June 30, 2025; the trades follow the state electrical, plumbing and gas codes. Holbrook’s own rules are its Zoning By-Laws (posted as amended September 11, 2019, with dimensional and use tables), the General By-Laws as revised and renumbered in June 2023 (demolition delay, swimming pools, wetlands protection and stormwater management), and the permit fees.

Section 4.1.2 of the Zoning By-Law sets the house-lot rules that most residential permits are checked against:

Holbrook residential dimensional regulations (Zoning By-Law 4.1.2)
DistrictMinimum lot / frontageFront / rear / side yards
Residence I60,000 sq ft / 200 ft35 / 40 / 20 ft
Residence II40,000 sq ft / 150 ft30 / 30 / 20 ft
Residence III20,000 sq ft / 125 ft25 / 25 / 15 ft
Residence IV20,000 sq ft / 125 ft25 / 25 / 20 ft

Houses are limited to 2½ stories and 35 feet (3 stories and 40 feet in Residence IV) and to 20% lot coverage. A house need not sit farther back than the average of the homes on either side, and a corner lot must meet the front yard on each street.

The department’s pages and the General By-Laws index do not include a Stretch or Specialized energy code adoption, so ask Inspectional Services which energy path applies before the plans are drawn.

Holbrook building department: who handles permitting

Inspectional Services handles building, electrical, plumbing and gas permits from one office. Holbrook permit types

Since January 1, 2020, building, sign and sheet metal permits have been filed on PatriotPermitPro, and the department’s notice says paper permits are not accepted. The fee schedule handles the exception: a paper application that does come in is charged an extra $25 for staff to attach it to the online system. Plumbing and gas fitting applications and the workers’ compensation affidavit are posted as downloadable forms.

Residential permits

The building application asks for the site, owner and contractor, the contractor’s Construction Supervisor License and Home Improvement Contractor registration numbers with photocopies of both, the construction type, number of stories, intended occupancy, a description of the work, plans and the estimated value. Its back page carries the sign-offs Holbrook requires before the Inspector of Buildings approves it: the Collector, Water Department, Health Department, Fire Department, Conservation, Planning, Highway Department and Historical Commission. The form also warns owners who take out a permit under the homeowner license waiver that they are not eligible for the state Home Improvement Contractor guaranty program.

Commercial permits

Commercial work, which in Holbrook includes buildings of three or more families, pays a $50 base fee plus $20 per $1,000 of total job cost, and a separate plan review fee scaled to project value: $250 from $50,000 to $500,000, $500 up to $1,000,000, $1,500 up to $5,000,000, and $200 for each further $1,000,000. Annual certificates of inspection cost $50, multi-family inspections $25 per unit and fire escape inspections $50.

What comes before the building permit

  • Tax collector and water. The Collector and the Water Department sign the application first.
  • Zoning and Planning. Planning signs the application, and variances or special permits go to the Zoning Board of Appeals. The dimensional table is set out below.
  • Conservation. Work near wetlands falls under the Wetlands Protection Act and Holbrook’s own wetlands by-law (Sec. 11-7), and land disturbance under the stormwater management by-law (Sec. 11-9).
  • Board of Health and Fire. Both sign every building application; septic work under Title 5 (310 CMR 15) goes through the Health Department.
  • Historical Commission. A building 100 years old or more, or of unknown age, goes through the demolition delay review before a demolition permit. The application must include a copy of the owner’s deed, photographs, the building’s estimated age, the reason for demolition and the planned reuse or replacement. The Building Inspector forwards it to the commission within 7 days; the commission decides within 14 days whether the building is significant (if the inspector hears nothing within 21 days, the permit can issue), holds a hearing within 30 days on a significant building, and decides within 14 days after the hearing whether it should be preferably preserved.
  • Highway Department. Its signature is also on the application form.

Holbrook permit costs and fees

The Inspection Services Permit Fee Schedule posted by the department is effective April 1, 2020. Fees are based on total job cost, and work started without a permit costs double.

  • Electrical: filed by a licensed electrician under 527 CMR 12. A new house is priced by floor area; hard-wired alarm systems are $40. Solar, siding and pool jobs need the electrical permit before the building permit issues.
  • Plumbing: filed by a licensed plumber on the town’s plumbing application; underground plumbing is inspected at $50 per inspection, and backflow devices are $50.
  • Gas: filed by a licensed gas fitter on the gas fitting application; a gas water heater needs both a $50 plumbing permit and a gas permit, and a pressure re-test is $50.
  • Mechanical and sheet metal: billed on job cost and filed online like building permits.

The building application requires photocopies of the contractor’s Construction Supervisor License and Home Improvement Contractor registration, together with the workers’ compensation affidavit.

Collector, Water, Health, Fire, Conservation, Planning, Highway and Historical Commission, as the application lists.

6. Pay and post

Pay the base fee plus the per-$1,000 charge and keep the permit at the site.

Plumbers in particular must call within 10 days to avoid the late-call charge.

Review, corrections and what causes delay

Under 780 CMR 105.3.1 the building official has 30 days from the application to grant or deny the permit. In Holbrook the usual slowdowns are an application filed on paper, missing license or HIC photocopies, a solar or pool permit waiting on its electrical permit, or a sign-off still outstanding from one of the eight departments on the form. Remember that the office is closed on Fridays when you plan follow-up calls.

Inspections in Holbrook

Inspections are requested through Inspectional Services at 781-767-9062 during office hours, Monday to Thursday. A failed building inspection costs $50 to repeat; residential plumbing re-inspections cost $100 and gas re-inspections $50.

When the work is complete, the certificate of occupancy is issued at $50 per unit. For commercial buildings, the department also makes annual certificate-of-inspection visits ($50) and fire escape inspections ($50 each). Vacant buildings must be registered with the town under the General By-Laws, a step the department posts beside its permit documents.

Massachusetts building code

Holbrook enforces the 10th edition of 780 CMR, the only edition accepted for applications since July 1, 2025, together with the Holbrook Zoning By-Laws. FEMA lists Holbrook as a participating community in the National Flood Insurance Program, with flood maps effective July 8, 2025.

Massachusetts has one State Building Code, 780 CMR, for every city and town; towns cannot rewrite it, though many opt into a stricter energy code. The trades run under their own state codes. Massachusetts rules
