In unincorporated Allamakee County, the Planning and Development office in the courthouse at 110 Allamakee Street, Waukon (563-568-3014), issues a building permit under the zoning ordinance before a building is put up, enlarged, given more dwelling units or changed in use. Fees adopted March 23, 2026 run from $50 to $500 on the estimated construction cost and triple if work has already begun. Building near a bluff or in a floodplain needs extra approvals, septic and well permits come from the Sanitarian, and electrical permits from the State of Iowa.
What requires a permit in unincorporated Allamakee County?
The zoning ordinance, known as Ordinance L, calls for a building permit before any construction or development: a new building, a structural change that adds to exterior size, height or floor area, a remodel that adds dwelling units, or a change of use. Any mobile home placed outside a mobile home park also needs one.
Building permit needed
- Non-farm houses, garages, sheds and additions
- Mobile homes outside a park
- Commercial and industrial buildings, signs and towers
- Home and farmstead home occupations and permanent roadside produce stands
- Golf courses, public ponds, commercial stables and kennels, sawmills, pits and quarries, campgrounds, private parks, hunting preserves and landfills
- Farm buildings that sit in a floodplain
- Data centers, solar, wind and battery projects
No permit
- Farmhouses, barns and outbuildings primarily adapted to and used for agriculture, if outside a floodplain
- Mailboxes, apiaries, farm fences and farm signs, even in a floodplain
- An attached garage or addition built within two years and shown on the original permit
- Electrical permits (State of Iowa)
The farm exemption carries a condition: a farm building escapes the permit only if it is outside the floodplain. Farm homes and other buildings meant for people to live in must meet the same floodplain rules as non-farm houses either way.
What Allamakee County decides and what the state holds
Ordinance L combines zoning and subdivision rules with a floodplain overlay, a bluffland protection overlay and standards for mobile homes, campgrounds and extraction pits; amendments have added utility solar (No. 15), wind energy (No. 19) and data centers (No. 20), and a separate battery storage ordinance is posted. The ordinances the county posts include no building code. Where a project needs state accessibility or energy-code compliance, the county waits for the state’s approval in writing and says it is not responsible for those inspections or certifications.
Allamakee County building department: who handles permitting
Stephanie Runkle, the Zoning Administrator and Floodplain Manager, issues building and floodplain permits and handles bluffland reviews, with the Planning and Zoning Commission and the Board of Adjustment hearing rezonings, conditional uses and variances. A Plat Review Committee meets weekly, and the Board of Adjustment takes applications by a monthly deadline (November 11 and December 9 in 2026).

Allamakee County permit types
The Planning and Development page posts the building permit application, the floodplain development regulation and permit application, the land division application (Form A), the zoning ordinance and its energy and data center amendments, the battery storage ordinance and the fee schedule.
Residential permits
The one-page application asks whether the work is a new structure or mobile home, an alteration or a change of use, and for the legal description, section, township and range, zoning, lot size, size and type of building, the estimated building cost (labor and materials from the ground up), bedrooms and bathrooms, the septic and well install dates, the four yard distances, the principal and current use and the contractor. The applicant certifies that the work meets the ordinance and lets the Zoning Administrator enter the property for the life of the permit. Staff mark which extras are needed: site plan, bluff survey, local and DNR floodplain permits, variance or conditional use permit.
The site plan must be drawn at no more than 1 inch to 50 feet, with a location map, north arrow, existing buildings, utilities, easements, trees and drainage ways, adjoining owners, the zoning district, water supply and sewage disposal, flood elevations where relevant and, when required, proof of an Iowa DNR ground water discharge permit. In the A-1 Agriculture district, a non-farm house needs at least 3 acres outside road right of way and easements (more if the Sanitarian says so) and 150 feet of width, with setbacks of 40 feet front, 30 feet rear, 10 feet side and 30 feet on a corner street side; the main building must be at least 16 feet wide and no taller than 35 feet or 2½ stories. Near Waukon, the city’s airport height limits apply as well.

Commercial permits
Data centers are governed by Amendment 20, adopted April 13, 2026. Micro data centers of 3 megawatts or less, in buildings of no more than 865 square feet, are allowed only in the A-1, C-1, I-1 and I-2 districts with a building permit. Large data centers over 3 megawatts are banned except as a conditional use in the I-2 General Industrial district: within 45 days of a complete application, the Zoning Administrator holds a public informational meeting at a Board of Adjustment meeting, owners within 2,000 feet are contacted, and notice is published 4 to 20 days ahead. Solar, wind and battery storage projects carry a $1,000 fee.
Splitting land starts with Form A, the land division application, which is filed with the County Auditor’s Office (563-568-3522), not Planning and Development. It names the owner and the surveyor or engineer, the reason for the split (a sale, estate planning or a mortgage, for example) and the approximate size of each new lot, with a drawing or aerial photo of the proposed lines and the plat, easement or deed that will provide access. The Zoning Administrator then reviews the current zoning, whether the land lies within 2 miles of a city, the 100-year floodplain and bluffland, and whether it must be rezoned first, and the County Engineer notes whether the land may suit a well and septic system. An agent, buyer or owner may sign the form, but every owner, spouses included, must sign the plat.
For tenant improvements and new commercial builds, Alliance handles commercial permit applications through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Bluffs. A bluff is a slope averaging 45% or more with a rise or drop of at least 50 feet. No structures are allowed in the Bluff Impact Zone (the bluff plus 50 feet beyond its top and 10 feet beyond its toe) except public projects, utilities and fencing; elsewhere in the Bluffland Protection District, which reaches 100 feet beyond the top and 30 feet beyond the toe, the Planning and Zoning Commission must approve a site plan signed by an Iowa professional engineer, with contours and an erosion control plan.
- Floodplain. A county floodplain development permit and, where required, an Iowa DNR permit.
- Septic and well. Permits from the Sanitarian.
- Driveway and address. A County Engineer entrance permit and an E-911 address.
- Land division. Form A and the subdivision plat deadlines for new lots.

Call 1-855-478-4290 →Allamakee County permit costs and fees
Resolution 26.113, approved March 23, 2026 and effective immediately, replaced the earlier fee schedule after a Planning and Zoning Commission review. Building permits use a sliding scale on estimated construction cost, and every fee is tripled for an application filed after construction or a change in use has started. Government projects pay no fees.
| Item | Fee |
|---|---|
| Building permit, estimated cost up to $9,999 | $50 |
| $10,000 to $99,999 | $125 |
| $100,000 to $249,999 | $225 |
| $250,000 to $499,000 (as printed) | $325 |
| $500,000 and up | $500 |
| Sign, on premise / off premise | $25 / $50 |
| Communication tower | $500 |
| Renewable energy or large data center (battery, solar, wind per turbine) | $1,000 |
| Floodplain development permit for structures | $200 |
| Construction in the Bluffland Protection District | $200 |
| Rezoning or text amendment | $250 |
| Variance, conditional use or appeal | $250 |
| Subdivision plat (minor, major, preliminary or final, one fee) | $150 |
| Special meeting | $300 |
A house with an estimated cost of $320,000 pays $325 for the building permit; if it sits in the Bluffland Protection District it adds $200, and filed after work began the permit alone becomes $975. A permit lasts two years and can be renewed for one more year at the cost of the original permit. The county does not post its septic and well permit fees.
Trade permits and who may pull them
- Electrical: the county pages describe no electrical permit or inspection program; rural wiring is permitted and inspected through the State of Iowa’s DIAL electrical program.
- Septic and wells: the Environmental Health Director, who is also the county Sanitarian and a certified time-of-transfer inspector, issues private septic and well permits and tests private wells.
- Plumbing and mechanical: state licensed trades, with no county permit.

How to get an Allamakee County building permit
Confirm zoning, floodplain and any bluff with Planning and Development.
Get Sanitarian permits; the form asks for their install dates.
The Engineer approves access; E-911 assigns the address.
Draw to scale; add an engineer’s bluff plan if needed.
File before work starts to avoid triple fees.
The electrician obtains the state permit.
Review, corrections and what causes delay
A missing bluff survey, floodplain permit or DNR approval holds the building permit, and a variance or conditional use waits for the Board of Adjustment’s monthly application deadline and hearing. Plats go through the weekly Plat Review Committee with their own monthly submission deadline (November 10 and December 8 in 2026). Large data centers add the 45-day informational meeting step.
Inspections in Allamakee County
The county does not inspect footings, framing or finished buildings for code compliance; its permit checks zoning, setbacks, floodplain and bluff rules, and the Zoning Administrator may visit the site while the permit is open. The Sanitarian oversees septic and well work under those permits.
In the floodplain, the lowest floor of a new or substantially improved home, basement included, must be at least 1 foot above the 100-year flood level, built on compacted fill at least that high reaching 18 feet beyond the building, unless the Board of Adjustment accepts an engineer’s plan for piers or another method; a new home also needs access passable by vehicles during the 100-year flood. Non-residential buildings are elevated or floodproofed to the same level, with an Iowa engineer certifying any floodproofing, and factory-built homes must be on a permanent foundation 1 foot above flood level and anchored against flotation. For an E-911 address, the application needs a sketch showing the exact driveway location relative to the property lines; for an existing driveway, the E-911 office obtains the Engineer’s written confirmation that it is an approved access before assigning a number and installing the sign.
Iowa building code
The ordinances Allamakee County posts include no building code; its building permit enforces Ordinance L, the floodplain regulation and the bluffland overlay. FEMA’s Community Status Book lists Allamakee County as participating in the National Flood Insurance Program, with its current flood map effective September 18, 2020.
