Calumet County's code administrators handle zoning, building and land use permits, sanitation, floodplain, mining reclamation and wind energy standards — plus one programme almost unique among Wisconsin counties: limiting building height in communication paths, known as Fresnel zone management.

The county's general zoning ordinance is Chapter 82 of the county code, in effect in the towns of Brillion, Charlestown, New Holstein and Woodville, with shoreland zoning under Chapter 52 governing development within a thousand feet of navigable lakes, ponds or flowages and three hundred feet of navigable rivers or streams.

This guide covers unincorporated Calumet County under county zoning. Appleton, Kaukauna, Chilton, New Holstein, Brillion, Sherwood and Harrison permit their own construction — and Appleton spans this county as well as Outagamie and Winnebago.

📜

Height limits you would not expect. Alongside zoning, floodplain, sanitation, road access, wetland regulation, mining reclamation and wind energy standards, the county administers limits on building height in communication paths — Fresnel zone management. On a tall structure, check this before design rather than after.

What requires a building permit in Calumet County?

Wisconsin splits construction into two statewide instruments, and neither one is a city invention. One- and two-family homes run on the Wisconsin Uniform Dwelling Code (SPS 320 to 325), a code Wisconsin wrote for itself — the state never adopted the International Residential Code, so IRC chapter references from other states simply do not apply here. Everything that is a public building or a place of employment, including any residential building of three or more units, runs on the Wisconsin Commercial Building Code (SPS 361 to 366), which moved to the 2021 I-codes effective September 1, 2025; plans submitted on or after November 1, 2025 must comply with the 2021 editions. Under Wis. Stat. 101.65(1c) and 101.02(7r)(a), Calumet County may not enforce different technical standards — local ordinances must strictly conform to the state codes.

Typically permit required

  • County zoning permits under Chapter 82 in the towns of Brillion, Charlestown, New Holstein and Woodville
  • Shoreland zoning approvals under Chapter 52 near navigable water
  • Sanitary permits, submitted online by certified soil testers and licensed plumbers
  • Floodplain approvals where mapped
  • Wind energy and mining reclamation approvals where applicable
  • The town or municipal building permit

Often exempt

  • General county zoning in towns that did not adopt Chapter 82
  • State highway construction, reconstruction, maintenance and repair by the state transport department where the statute applies
  • Buildings used for farming — exempt from the state code under Wis. Stat. 101.05(5), with farming defined by DSPS rule; a produce stand stays exempt only while the farmer raised substantially all of what it sells
  • Primitive rural hunting cabins — carved out of municipal jurisdiction by Wis. Stat. 101.65(1g)
  • Bed-and-breakfast establishments as defined by statute (Wis. Stat. 101.05(2))

What is actually local, and what is not

Building standards are statewide. Calumet County's layer includes the Chapter 82 land use regulations, the Chapter 52 shoreland standards which supersede general zoning provisions relating solely to shorelands, and the county's distinctive communication-path height and wind energy programmes.

Who handles permitting in Calumet County?

The Code Administrators administer and enforce the county's land use codes, assisted by the land information section which runs the county-wide geographic information system, rural house numbering, parcel mapping and emergency call data. Town and municipal building inspectors issue building permits.

Permit types

Residential permits

A rural house in county zoning jurisdiction needs the county zoning permit, with plot plans clearly identifying navigable water, wetlands and floodplain — the county prefers drawings on an aerial photo, which it will supply on request — plus floor plan and building profile with all bedrooms and bathrooms labelled. The town then issues the building permit.

How Wisconsin contractor licensing works

Wisconsin has no state general contractor license for commercial work — the city's own forms note that 2013 Wisconsin Act 20 ended state building-contractor registration on July 2, 2013. For one- and two-family work the state requires a Dwelling Contractor certification on the business and a Dwelling Contractor Qualifier on an individual, and under Wis. Stat. 101.65(1m) Calumet County may not issue a building permit to a contractor who cannot produce them; owner-occupants are exempt. Electricians and plumbers are licensed statewide by DSPS. HVAC contractors only register with the state — there is no state HVAC license — which is exactly where local rules step in. Calumet County licenses no trades; state credentials govern, and sanitary submissions come from certified soil testers and licensed plumbers.

Commercial permits

Commercial development under Chapter 82 needs county zoning approval and, where applicable, shoreland, floodplain, wind energy or communication-path review. Building code plan review routes to the state or a delegated municipality; the county holds no commercial plan review delegation.

Mechanical work, and where the state reviews directly

Commercial plan review in Wisconsin is a two-step: under Wis. Stat. 101.12(3)(h) the plan approval comes first and the local permit cannot issue without it. The state review trigger is 25,000 cubic feet, plus categorical triggers at any size for schools, high-hazard occupancies and residential buildings of three or more units. At 50,000 cubic feet plans must be prepared, signed and sealed by a Wisconsin-registered design professional, with a supervising professional retained for construction observation. Commercial plumbing plans go to review at sixteen or more fixtures. Land divisions for lots relying on private wastewater systems may carry a recorded restriction barring construction until state and county regulations are met and a county sanitary permit has issued.

Calumet County permit costs and fees

Zoning fees are submitted with the application by cheque; sanitary permits, soil tests and payments are handled online through the county's payment processor.

Wetland liability sits with the applicant. Under state statute the applicant must acknowledge responsibility for complying with state and federal law on construction near or on wetlands, lakes and streams — noting that wetlands not associated with open water can be difficult to identify, and that non-compliance may mean removal or modification of the construction.

Trade permits and who may pull them

Trades are state-credentialed and permitted at municipal level; the county's role covers zoning, sanitary and its specialised programmes.

Permit required

  • Electrical, plumbing and HVAC — state credentials; municipal permits
  • Private onsite wastewater systems — county sanitary permit, submitted online by a licensed plumber
  • Soil testing — certified soil testers, submitting online
  • One- and two-family general work — state Dwelling Contractor plus Qualifier

Typically exempt

  • General zoning matters in towns outside Chapter 82
  • Work inside cities and villages

How to apply for a Calumet County building permit

1. Check whether your town is under Chapter 82

Brillion, Charlestown, New Holstein and Woodville are; others zone themselves.

2. Check shoreland under Chapter 52

It supersedes general zoning provisions relating solely to shorelands.

3. Check communication-path height limits on tall structures

Fresnel zone management is a county programme.

4. Prepare the plot plan on an aerial photo

The county prefers it and will supply an aerial on request.

5. Submit sanitary online

Soil tests, permits and payments all run through the online process.

6. File the building permit with the municipality

Which issues and inspects under the state code.

Review, corrections and what actually causes delay

The distinctive risks here are vertical and hydrological: a tall structure caught by communication-path limits, or a wetland that is not obvious because it is not associated with open water. Both are cheaper to resolve at design stage.

Inspections in Calumet County

Building inspections are the municipality's. County activity covers zoning compliance, sanitary systems — with maintenance and system records publicly available through the county's online programme — and its specialised regulatory programmes.
