Kay County does not issue building permits or enforce a building code on land outside city limits. On June 29, 2026 the Board of County Commissioners stated in Resolution 26, 27-8 that the only county rules affecting buildings there are the FEMA floodplain regulations run by the Kay County Floodplain Board. Ponca City, Blackwell, Tonkawa, Newkirk and Kaw City handle permits inside their own limits; in Braman and Kildare, ask the town.
What needs a permit in unincorporated Kay County?
Resolution 26, 27-12 states that no county-wide ordinances or building codes have been enacted, and that any zoning-type limits on county roads are set case by case. What remains on county land:
County approvals
- Any building, fill or other development on property the Floodplain Board regulates under the FEMA floodplain rules
- Pipelines, water lines, power and phone lines laid across, along or over a county road (public service and pipeline crossing permit)
State approvals
- Buildings in the International Building Code’s use and occupancy classifications, such as commercial, industrial and assembly buildings: State Fire Marshal building permit
- New or modified septic system: DEQ Authorization to Construct
A house, barn or shop on rural land outside a floodplain needs no county building permit, because the county has no building program.

With no county building department, there is no county electrical, plumbing or mechanical permit. Inside a town, trade permits come from the town. In Tonkawa, the permit for a new building or addition covers its structural, plumbing, electrical and mechanical work done during the initial construction, any other work needs its own permit, and subcontractors must be licensed, registered or bonded with the City where that applies. Trade contractors hold Construction Industries Board licences.
Septic systems are permitted by the Oklahoma Department of Environmental Quality, not the county. An Authorization to Construct must be bought and issued before a system is installed or changed; DEQ assigns it to the Environmental Specialist for the property’s area, and soil profiles may only be done by DEQ or a DEQ-certified soil profiler.
Kay County permit fees
The county’s published fees are for work in county road right-of-way. The schedule printed on the public service and pipeline crossing form (revised February 21, 2017) asks for a check with the application:
| Work | Fee |
|---|---|
| Road bored, permanent line | $500 |
| Cut or trenched, temporary | $1,500 |
| Cut or trenched, permanent | $2,500 |
| Overhead line | $500 |
| Parallel water line | $250 a mile |
| Temporary lines through culverts or bridges | $500 |
| Above-road crossing | $1,500 |
| Line placed in county right-of-way without a permit | $10,000 fine plus court fees |
For a building the State Fire Marshal permits outside city limits, it charges $0.20 per square foot plus a $4 OUBCC fee, with a $104 minimum. Inside a town, the town’s own fees apply; Tonkawa’s form, for instance, totals a permit fee, plan review fee and inspection fee.

- Road crossing or line installation: the county form with owner and contractor details, type of line (electric, gas, oil, water, telephone, sewer), method (trenching, boring, pushing or overhead), the quarter-section, township and range of the start and end points, pipe or cable specifications and a map on the form’s last page. The applicant also affirms it has the landowners’ permission, because the permit grants no right-of-way on private land.
- Floodplain development: contact Emergency Management, which runs county floodplain management, before plans are drawn.
- State Fire Marshal building permit outside a town: plans uploaded to the State Fire Marshal’s Accela portal, drawn to the state minimum codes.
How to get a permit in Kay County
If the site is inside Ponca City, Blackwell, Tonkawa, Newkirk or Kaw City, apply to that town; in Braman (580-385-2169) or Kildare, ask the town first.
Call Emergency Management at 580-362-3825 to learn whether the land is regulated by the Floodplain Board.
Submit the crossing form and fee check to the County Clerk no later than 5 days before a commissioners’ meeting.
For a building in an International Building Code occupancy group (a store, church, apartment building or warehouse, for example), apply to the State Fire Marshal; for a septic system, buy a DEQ Authorization to Construct.
A county crossing permit is in force for 30 days from verbal or written approval, whichever comes first.

The county carries out no building inspections. For a road crossing, the contractor must call the commissioners’ office or road foreman 48 hours before starting and again at completion for an on-site inspection. Crossings under blacktop or asphalt must be bored; cutting a caliche or dirt road needs the commissioners’ approval, and blasting is not allowed.
In the towns, the town inspects. Tonkawa takes inspection requests at 580-628-1458 until 5:00 p.m. on the working day before, and its form lists stages from foundation and slab through framing, insulation and final. Blackwell’s Code Enforcement office schedules its own inspections. Septic systems are inspected by DEQ or a certified installer before use.
