Sierra County has no building department. The County posts the state’s residential and commercial building packets on its Forms & Permits page, and the building permit is issued by the Construction Industries Division (CID). What the County itself issues is a floodplain development permit through Emergency Management ($25, or up to $85 with inspections), a rural address through its GIS Department, and road permits. In Truth or Consequences, Elephant Butte and Williamsburg the town gives zoning or land use approval and CID still issues the building permit.
What needs a permit in Sierra County?
For construction, the answer comes from the state’s building rules, applied by CID. The County adds permits only where its own ordinances reach:
Sierra County
- Floodplain development permit: new structures, additions, alterations, relocation, demolition and replacement, manufactured homes, and also fill, grading, excavation, drilling, mining, drainage and culvert work, road or bridge construction and individual water or sewer systems in a flood hazard area
- Rural address from the GIS Coordinator
- Subdivision review, or a claim of exemption when combining or splitting land
- Road Superintendent’s permit to place utilities, culverts, cattle guards or other infrastructure in, under or across a county road
- County business licence
State CID
- Building permits for residential and commercial construction
- Electrical, mechanical and plumbing permits
- Manufactured home permits, through the state Manufactured Housing Division
A floodplain determination costs nothing. If Emergency Management finds the site is outside the Special Flood Hazard Area, the review is complete and no floodplain permit is needed.
Who issues permits in Sierra County?
CID issues the building permit throughout the county. The County has no building department, and each municipality’s published process is a zoning or land use approval that sits beside the state application:

The City’s Community Development office gives zoning approval on its Building Zoning Approval Application (or the Manufactured Home Zoning Approval), and the building permit is the state’s: the City lists the state’s General Building Permit Application and Manufactured Housing Permit forms on the same page. Office: 401 McAdoo Street, 575-952-0565.
- Elephant Butte (population 1,456): the City says it has no building permit or inspection department, so the State issues all construction permits, and that the State typically wants the City’s zoning permit before it issues. The zoning permit is filed on the General Land Use Application with the City Code Enforcement Officer before construction or use of the property starts. City Hall: 575-744-4892.
- Williamsburg (population 458): the Village asks owners to check with Village Hall before building or remodeling, because a Municipal Land Use Permit may be needed. Village Hall: 309 Veater Road, 575-894-6385.
- Unincorporated county: floodplain review and addressing at the County offices, then CID.

Forms the County publishes
Everything is on the County’s Forms & Permits page:
- Residential Building Packet and Commercial Building Packet. These are the state’s documents: CID’s building permit guide, the Multi-Purpose State Building Application, the homeowner’s responsibilities form for an owner-builder, an energy plan review checklist and sample site, foundation, floor and framing plans.
- Floodplain Development Permit Application, 4 pages, filled out in duplicate.
- Application for Rural Address.
- Claim of Exemption Form for combining or splitting land.
- Manufactured Home Tax Release Request, an Assessor’s form.
- Business License Application.

Sierra County fees
The floodplain fees are printed on the County’s application and depend on how many inspections the permit needs:
| Floodplain item | Fee |
|---|---|
| Floodplain determination | $0 |
| Permit fee | $25 |
| Permit with 1 inspection | $45 |
| Permit with 2 inspections | $65 |
| Permit with 3 inspections | $85 |
| Re-inspection | $20 |
| Requested inspection | $20 |
| Permit renewal | $10 |
The state permit is priced by CID and applied for through its online portal; the City of Elephant Butte points builders to CID’s Las Cruces office (505 South Main Street, Suite 103, 575-524-6320). Elephant Butte adds a $25 flood plain review to every state-permitted project in the city, and doubles its residential land use application fee when construction has already begun.
Electrical, plumbing and mechanical permits
Trade permits in Sierra County are CID permits, applied for through the state’s online portal. The state’s homeowner form, included in the County’s residential packet, makes clear that a homeowner’s building permit covers general construction only: electrical, mechanical and plumbing work is permitted separately.
Elephant Butte recommends contacting CID before filing with the City, because the state’s requirements for the building permit shape what the City asks for.

County floodplain application
- Project location: street address, lot number or legal description, with a sketch
- Description of the work and the estimated cost
- A site plan showing existing structures, water bodies, adjacent roads, lot dimensions and the proposed development
- Scaled development plans with anchoring details and the proposed elevation of the lowest floor
- For a subdivision or other development over 50 lots or 5 acres, whichever is less, the 100-year flood elevations
- In a regulatory floodway, a registered engineer’s certification that the work will not raise the 100-year flood height
State building application
- Multi-Purpose State Building Application, signed
- Zoning and floodplain approval signatures where they apply
- Site plan, foundation plan, floor plan and framing plans
- The notarized homeowner’s responsibilities form for an owner-builder

Get a free quote →Inspections
CID inspects construction under its permits. The County inspects only under a floodplain permit: the applicant consents to reasonable inspections by the local administrator, the permit fee is tied to 1, 2 or 3 inspections, and a development may not be used or occupied until the Certificate of Compliance is issued. An applicant whose floodplain application is found deficient gets a written summary and can revise and resubmit it.
