DeSoto County is the third-most-populous county in Mississippi at about 198,000 residents, the state’s Memphis-metro anchor and the county that has added the most residents since 2020. Its Planning and Building Department in Hernando processes permits and inspects all commercial, residential and industrial construction — and, unusually for Mississippi, maintains the licensing for general contractors and subcontractors in the county.

This guide covers the Planning and Building Department and how to reach it, the county’s local contractor-licensing role, the seismic-design context of northwest Mississippi, and how the online portal and fees work.

This guide covers unincorporated DeSoto County. Southaven, Olive Branch, Hernando and Horn Lake run their own planning departments, and the Town of Walls is also incorporated; confirm with the town for work inside Walls.

🏗

DeSoto County runs a full building program, and it also licenses contractors locally. The building staff maintain the licensing for general contractors and for subcontractors — plumbers, electricians and mechanical contractors — alongside processing permits and inspecting all construction. It also administers a Comprehensive Plan and Design Standard Ordinance.

What requires a building permit in DeSoto County?

Mississippi is a local-option state: the Mississippi Building Codes Council designates recent editions of the International Codes as statewide minimum codes, and under Senate Bill 2378 of 2014 counties and municipalities must adopt them unless they opted out before 30 November 2014 (Mississippi Code §17-2-4; the five coastal counties have separate wind and flood requirements under §17-2-1). So the first question on any project here is not what the code says — it is whether the Planning and Building Department enforces a building code at all, and what it requires where it does.

Permit required

  • New residential and commercial construction, additions, alterations and conversions
  • Structural and load-bearing work, foundations, decks, porches, ramps and stairs
  • Finishing basements and attics, and any change of use or occupancy
  • Electrical service changes, panel work, new circuits, solar and EV charging equipment
  • Plumbing alterations, repipes, water heaters, backflow and sewer or gas connections
  • HVAC installation and change-out, ductwork and venting; roofing, siding, windows, pools, signs and demolition

Typically exempt

  • Painting, wallpapering, tiling, carpeting and cabinet installation
  • Minor repairs and finish work replacing materials in kind
  • Small accessory structures below the local size threshold, where zoning allows
  • Farm structures and manufactured housing, which the code chapter exempts

Where a jurisdiction enforces the code, exemptions are narrow and local, and an exemption from a building permit is never an exemption from zoning, setbacks, floodplain rules, utility approval or a fire review. Confirm scope with the Planning and Building Department before work starts rather than after.

Which code applies — and whether one applies

DeSoto County enforces a building code and issues permits in its unincorporated areas, so a permit, inspection and certificate of occupancy are required. Because northwest Mississippi lies near the New Madrid seismic zone, the residential code’s seismic-design provisions can apply here in a way they do not further south — confirm the seismic design category for the parcel.

Some work is exempt statewide: farm structures once the owner files an affidavit (Mississippi Code §17-2-7), and manufactured housing built to federal standards, certain industrial and utility facilities, buildings on non-public fairgrounds and hunting or fishing camps with an owner’s affidavit (§17-2-9). None of these exemptions reaches floodplain rules. The state minimum codes are the Mississippi Building Code and Mississippi Residential Code, the residential code drawn from the 2021 International Residential Code. The building personnel process permits and inspect all commercial, residential and industrial building, and they maintain the licensing for general contractors and subcontractors in the county — so on a DeSoto project the local licensing check is a real gate, separate from the MSBOC state thresholds. Planning staff maintain the zoning map, the DeSoto County 2030 Comprehensive Plan and a Design Standard Ordinance.

Most of the county’s population lives in Southaven, Olive Branch, Hernando and Horn Lake, which run their own departments; the Town of Walls is also incorporated. Confirm the jurisdiction from the parcel first.

In 2025, building permits issued in unincorporated DeSoto County authorized 416 new privately owned housing units, all of them single-family homes, according to the U.S. Census Bureau Building Permits Survey.

Permit types

Residential permits

Fast Memphis-metro growth drives heavy residential volume. Re-roofs and solar need permits, seismic detailing can apply in this part of the state, and while state licensing starts above $50,000 for a new home and above $10,000 for a remodel or re-roof, the county’s own contractor registration applies regardless.

Commercial permits

Commercial and industrial work — distribution, retail and manufacturing in the Memphis logistics belt — runs through county plan review and inspection and crosses the MSBOC commercial threshold of $50,000, with county registration on top.

Mississippi licenses contractors through the Mississippi State Board of Contractors: a commercial certificate of responsibility for commercial and public work of $50,000 or more, a residential builder licence for a new home costing more than $50,000, and a residential remodeling licence for improvements to an existing home costing more than $10,000. Below those amounts DeSoto County’s own permit, inspection and registration rules still apply where it enforces the code. Contractor licensing in Mississippi

Fee schedules in Mississippi are set locally and revised on each jurisdiction’s own cycle, so ask DeSoto County for the schedule in force on your filing date, and ask separately about plan review, trade, re-inspection and revision charges. How Mississippi permit fees work

Trade permits and who may pull them

Trade permits are generally separate from the building permit and are issued to the licensed installer where a jurisdiction enforces the code. State licensing through the Mississippi State Board of Contractors starts at $50,000 on commercial work and above $10,000 on residential remodeling, and the Board states that residential electrical, plumbing or HVAC work under $10,000 needs no state licence; a jurisdiction may add its own registration, so the credential check depends on both the project value and the jurisdiction. Confirm each before filing rather than after the first correction notice.

Permit required

  • Service installations, panel upgrades, new circuits, solar PV and EV chargers
  • New plumbing, repipes, water heater change-outs, fixtures, backflow and gas piping
  • HVAC installation and change-out, ductwork, venting and commercial kitchen exhaust
  • Sprinkler, standpipe and fire alarm work on commercial and multi-family structures

Typically exempt

  • Replacing a fixture, switch, receptacle or light with no alteration to wiring or piping
  • Clearing a stoppage without replacing or rearranging concealed piping
  • Filter, thermostat and routine component service
  • Appliance repair that does not alter the gas, electrical or venting connection

Electrical, plumbing and mechanical contractors hold MSBOC classifications on commercial work of $50,000 or more. A jurisdiction that enforces the code may also require local trade registration regardless of project value, while some that have opted out require no local trade permit, so confirm before assuming either way. How to apply for a DeSoto County building permit

1. Confirm the parcel is unincorporated

Southaven, Olive Branch, Hernando and Horn Lake file with their own cities; confirm with the Town of Walls for work there.

2. Register with the county as a contractor

DeSoto licenses general and trade contractors locally, separate from MSBOC.

3. Confirm the seismic design category

Northwest Mississippi can require seismic detailing.

4. Test project value against MSBOC

Commercial certificate at $50,000; residential builder above $50,000, remodeling or roofing above $10,000.

5. Use the Citizen Self Service portal

Building applications and tracking run online. Electrical, mechanical and plumbing permit forms are mailed to the department with a check or brought to the office.

6. File, then track the review actively

Confirm receipt and check status at intervals.

In Mississippi, correction cycles turn mostly on the local layer: which code edition DeSoto County enforces, whether a coastal or flood-zone parcel triggers wind and elevation requirements, whether the project value crosses a state licensing threshold, and whether the submittal has the sets and forms the office requires. Permits also carry a validity period set by the issuing jurisdiction, so confirm the expiry on phased or delayed work. Review and corrections in Mississippi

Inspections in DeSoto County

Where the jurisdiction enforces the code, standard checkpoints include footing and foundation, framing, rough-in trades, insulation and energy, fire systems on commercial work, and final, with occupancy approval before use. Seismic design categories add connection and bracing verification.

Confirm bookings rather than assuming them, and give the notice the office asks for — an unconfirmed inspection request is a scheduling risk you can remove with one call or visit.

Do not cover work before the required inspection has been approved. Keep the issued permit, the approved plans, energy and wind documentation, product listings, any special-inspection reports and your correction responses available on site.

DeSoto County permit search and official resources

Permit records in Mississippi sit with the local authority that issued them — where the Planning and Building Department enforces the code, it holds the building permit, the inspection history and the certificate of occupancy for work in unincorporated DeSoto County. If you are buying, refinancing or renovating, ask what it holds for the parcel, and confirm that past work was permitted rather than assuming it was.

🔍

Confirm whether a code is enforced, then confirm the local layer. Mississippi’s opt-out framework means the answer varies by jurisdiction; the fee schedule, submittal list, review turnaround and any coastal or flood requirements are the local authority’s to set. Confirm current requirements, fees and review turnaround for your filing date.

These are the primary sources behind this guide. Codes, fee schedules and portal procedures change, and a jurisdiction’s own published packet can lag — the adopted ordinance governs, not an un-updated handout. Confirm the position for your filing date.

Does DeSoto County license contractors itself?

Yes. Unusually for Mississippi, the county maintains local licensing for general contractors and for subcontractors — plumbers, electricians and mechanical contractors.

Does seismic design apply in DeSoto County?

It can. Northwest Mississippi lies near the New Madrid seismic zone, so the residential code’s seismic-design provisions may apply; confirm the design category.

Does the county or the city issue my permit?

Work inside Southaven, Olive Branch, Hernando and Horn Lake files with those cities, and work inside the Town of Walls should be confirmed with the town; unincorporated ground is a county matter.

Do I need a state contractor licence for a small job?

A state residential builder licence is required above $50,000 for a new home, and a remodeling or roofing licence above $10,000, but DeSoto’s local contractor registration applies regardless of value.

What code does DeSoto County enforce?

A recent edition of the International Codes as adopted locally; confirm the current edition and any amendments with the department.
