Alliance Permitting can prepare, file and track the permit for you and schedule the inspections.

The Westport Building Department, in the Town Hall Annex at 856 Main Road, takes every building, wiring, plumbing and gas application through PermitEyes and books inspections by phone; Westport has been a Stretch energy code town since 2019.

In Westport, the Building Department at the Town Hall Annex, 856 Main Road, issues building, wiring, plumbing and gas permits, and homeowners and contractors file every one of them online through PermitEyes. A new house or addition is charged $0.75 per square foot of gross floor area or 1% of the total cost, whichever is higher, under the fee schedule dated January 1, 2026.

Inspections are still arranged by telephone rather than in the portal, and wiring inspections go to one of two wire inspectors, split between the north and south ends of town.

What needs a building permit in Westport?

The department’s FAQ says a permit is needed in most cases for construction, repair, renovation or demolition, and names the smaller jobs people forget:

Permit required

  • New homes (a foundation-only permit comes first), additions and modular homes
  • Wood and pellet stoves, vinyl siding, roof re-shingling, replacement windows and doors
  • Above-ground and in-ground pools
  • Sheds, garages and barns of 200 square feet or more on residential land; 120 square feet or more on commercial land
  • Decks, porches and carports, structural repairs, demolition, signs and solar arrays
  • A pool fence 7 feet or taller (its own permit)
  • Any removal of wiring, fixtures or devices, under the wiring fee sheet

No building permit

  • Residential sheds under 200 square feet, which must still meet the setbacks
  • Fences not over 7 feet tall
  • Interior finish work such as painting, tiling, carpeting, cabinets and countertops

What the town decides and what the state holds

The State Building Code, 780 CMR, is set by the state and Westport cannot amend it. The town controls the Zoning By-Laws (amended May 5, 2026), the general by-laws, fee schedules set by the Select Board after a hearing under Article XXXII, the Stretch code choice, a demolition by-law, the Westport Point Historic District and local septic rules.

Westport building department: who handles permitting

The Building Department issues all four kinds of construction permit for the whole town. Ralph Souza is the Building Commissioner and also the Zoning Enforcement Officer, so zoning questions on a building application are answered in the same office.

Residential permits

A new dwelling needs labeled floor plans with clear dimensions, stamped truss plans where trusses are used, a site map, a RESCheck energy report on the 2021 IECC, and, from a contractor, HIC and Construction Supervisor License copies plus the owner’s authorization or signed contract. A modular home is applied for by a license holder. Alterations need existing and proposed plans; windows, doors, roofs, siding and insulation are quick permits needing only the contract and licenses. Metal buildings and solar arrays need engineer-stamped plans; sheet metal, a Manual J.

Commercial permits

Commercial work has its own fee sheet: $1.00 per square foot of gross floor area or 1% of total cost, whichever is higher, for new buildings and additions. Any structure over 30,000 cubic feet needs construction control.

What comes before the building permit

  • Zoning: residential setbacks are 25 feet from the front line (from both streets on a corner lot), 10 feet from the sides and 6 feet from the rear. A new single-family lot needs 60,000 square feet, at least 30,000 of it contiguous upland, and 150 feet of frontage; a duplex needs 80,000 square feet, 40,000 of it upland, and 200 feet. Buildings are limited to 40 feet. Special permits and variances go to the Zoning Board of Appeals, and a zoning-only buildable-lot letter costs $40.
  • Board of Health: properties on septic come under Title 5 and the town’s own local septic regulation. The Board, also at 856 Main Road (508-636-1015), charges $275 for a new or upgraded residential disposal system permit, $225 for a repair, $350 for a perc test of up to four holes and $100 to review a residential pool against Title 5 setbacks.
  • Conservation Commission: coastal, river and wetland sites need its review under the Wetlands Protection Act; pools pay a separate $25 Conservation review fee, and the Commission’s documents include a town Soil Conservation Bylaw.
  • Historic review: exterior changes inside the Westport Point Historic District need the Historical Commission, and demolishing a building on the town’s Historical Inventory triggers the demolition by-law described in the energy code and local rules section.
  • Flood zones: the Zoning By-Laws carry a Flood Plain District, section 6.1.

Westport building permit fees

The Building Commissioner signed both building fee sheets with a January 1, 2026 date. Most work is priced by gross floor area or by 1% of the total cost, whichever produces more, and every fee is rounded to the nearest dollar.

Worked example. A 400-square-foot family-room addition with a total cost of $60,000: the area rate gives 400 × $0.75 = $300, and 1% of the cost gives $600. The higher figure applies, so the building permit is $600, above the $200 minimum. Wiring, plumbing and gas permits are extra.

Permits are not refundable, and a permit not taken out in a timely manner can be charged a late filing fee of up to five times the original amount; the same penalty appears on the trade fee sheets.

Trade permits and who may pull them

Wiring, plumbing and gas permits are filed in PermitEyes under their own record types, and the FAQ says a homeowner cannot call in a trade inspection: the licensed electrician or plumber who did the work must. Under the plumbing sheet, no plumbing or gas piping may be built, added to or altered, apart from repairing leaks, until the plumbing and gas inspector grants a permit.

How to apply for a Westport building permit

1. Check zoning and the lot

Confirm the district on the town GIS “Zoning and Districts” theme and check the setbacks.

2. Clear health and conservation first

On septic land, start with the Board of Health; near wetlands, the coast or a river, start with the Conservation Commission. A lot letter covers zoning only.

3. Get a site plan

New structures and additions need one. The department has plans on file for some properties; otherwise a registered land surveyor prepares it.

4. Register in PermitEyes

Create a Westport account, choose “New Application” and the permit type.

5. Attach the documents for your job

Plans, RESCheck report, licenses and the owner’s authorization or contract, following the required-documents list.

6. Pay and keep the permit on site

Pay online by card or at the office by cash or check, then call to book each inspection.

Review, corrections and what causes delay

Under 780 CMR 105.3.1 the building official has 30 days from the filing of an application to grant or deny it; the FAQ says larger projects are usually issued within two to four weeks. Missing attachments cause delays, as do outside approvals: Board of Health septic, Conservation Commission, a Historical Commission vote or a surveyor’s site plan. A new house needs its foundation-only permit first.

Inspections in Westport

Building, plumbing and gas inspections are booked at (508) 636-1035, wiring inspections directly with the north or south end wire inspector; plumbing and gas visits are made between 3:00 and 5:00 p.m. unless the office says otherwise. For a new building the FAQ lists five building inspections: footing with keyway, foundation walls with waterproofing, rough frame after the trade roughs pass, insulation, and final.

For occupancy, the permit holder applies in PermitEyes; once every sign-off, including the Board of Health and Fire Department, is in, the $100 residential fee is paid online or at the counter. Older paper permits need the same sign-offs on the card. If a contractor changes mid-job, the work is inspected before the new contractor starts.

Energy code and local rules in Westport

Westport adopted the Stretch energy code by general by-law, Article LXVIII, with a concurrency start of July 1, 2018 and a sole effective date of January 1, 2019; the Building Commissioner enforces it. Under the demolition by-law, Article LIII, an application to demolish a building on the Historical Inventory goes to the Historical Commission, which has 30 days to say whether the permit can issue; if a public hearing finds the building preferably preserved, the permit can be held for up to 365 days, and a building demolished in breach of the by-law bars a new building permit on the parcel for two years. In the Westport Point Historic District, the Commission has 45 days to decide on a certificate of appropriateness unless the applicant agrees in writing to more time.

Massachusetts has one State Building Code, 780 CMR, for every city and town; towns cannot rewrite it, though many opt into a stricter energy code. The trades run under their own state codes. Massachusetts rules

Westport permit search and official resources

PermitEyes has no public permit search, so older permits come through the office or a records request. Under Article XII of the by-laws, each issued building permit application is posted on the Town Hall bulletin board within 24 hours, for at least 10 days. Records requests go to the Town Clerk (508-636-1000) or the online form with “Building” selected; the first two hours of search are free and copies are 5 cents a page.

Inspections are where schedules slip.

Westport building permit FAQ

How much is a building permit for an addition in Westport?

$0.75 per square foot of gross floor area or 1% of the total cost, whichever is higher, with a $200 minimum over 200 square feet. A 400-square-foot addition costing $60,000 pays $600.

Do I need a permit for a shed in Westport?

On a residential lot, only at 200 square feet or more; on commercial land, from 120 square feet. Every shed, permitted or not, must meet the 25-foot front, 10-foot side and 6-foot rear setbacks.

How do I schedule an inspection in Westport?

By phone. Call (508) 636-1035 for building, plumbing and gas, or the north-end (508-525-3799) or south-end (508-509-3840) wire inspector for wiring. Plumbing and gas inspections are made in the afternoon, between 3:00 and 5:00 p.m.

Can a homeowner call for an electrical or plumbing inspection?

No. In Westport the licensed electrician or plumber who did the work must request the inspection.

What does a pool need in Westport?

A building permit, a $100 Board of Health review and a $25 Conservation review, paid separately. An in-ground pool needs a 4-foot fence with a self-latching gate; a fence 7 feet or taller needs its own permit, and only a cover that meets the Massachusetts rules can replace the fence.

Which energy code applies in Westport?

The Stretch code. Article LXVIII of the town by-laws made it the sole energy code from January 1, 2019, so new-home applications include a RESCheck or other energy report.

How do I find out whether a lot is buildable?

Bring the Assessor’s index cards for the lot and each abutting lot, plus the Assessor’s map, to the Building Department and pay $40 for a lot determination letter. It covers zoning only.
