Newburyport is a city, and its Building Department, led by the Building Commissioner, enforces the State Building Code and the city’s Opt-In Specialized energy code. A building permit costs a $50 base fee covering the first $1,000 of total building cost, plus $10 for each further $1,000, and building inspections are booked by phone at (978) 465-4405 or online, never for the same day.

What work requires a building permit in Newburyport?

The Building Department’s inspection page doubles as a list of the building-side permits it handles. Each job type below has its own inspection, booked through the department, and the trades run under their own permits.

Permits the department inspects

  • New construction and building alterations
  • Swimming pools
  • Signs and tents
  • Wood stoves
  • Roofing, weatherization, and doors and windows
  • Solar installations
  • Sheet metal work
  • Electrical, plumbing and gas work, each under its own permit

Outside the building permit

  • Minor work on the state exempt list, 780 CMR section 105.2
  • An exempt job can still need Conservation Commission or zoning approval, as Plum Island fences show

Fences on Plum Island show how a small job can need a city approval even where the building code asks for little. The Wetlands Protection Ordinance (Chapter 6.5, Article II) and its regulations require any new fence on the island to be at least 80% open for the first 2 feet above grade and at least 50% open above that, measured looking straight at the fence and kept uniform along each section, so that sand can move across the island. Open rail, modified split rail, modified stockade and post-and-rope designs are accepted; solid stockade, standard picket, lattice combinations, shadow-box and louver styles are not. Repairing more than 10% of an existing fence that does not meet the rule means bringing the whole fence into compliance, and every fence must also meet the Zoning Ordinance’s visibility and safety rules. Plans showing the fence, posts and a typical section go to the Conservation Commission for approval, which takes them by email at Conservation@cityofnewburyport.com.

What Newburyport decides and what the state holds

The Building Department states that the city enforces 780 CMR, 10th edition, as issued by the state Board of Building Regulations and Standards; neither the City Council nor any city office can amend that code. Newburyport’s own rules come from its Code of Ordinances, including the Zoning Ordinance and the Wetlands Protection Ordinance, and from the city’s energy code choice. On that point the department is explicit: the city has adopted the 225 CMR Opt-In Specialized energy code, which sets higher efficiency and climate standards for new construction and certain renovations.

Newburyport building department: who handles permitting

The Building Department, under Building Commissioner Greg Earls, issues building permits and posts the fee sheets for electrical, plumbing, gas and sheet metal permits as well, so the building and trade permits for a Newburyport job are all priced on this one office’s pages; its staff include an office manager and an inspectional services clerk alongside the Commissioner. The department changed its public hours, and the current schedule opens at 7 am each weekday.

Newburyport permit types

Newburyport prices most building work with one formula, but the trades each have their own fee sheet: electrical (updated in 2023), plumbing and gas (2021) and sheet metal. The department also issues certificates of inspection and keeps a public list of building permits issued.

Residential permits

For a house, the building permit is worked out on the total building cost with every trade included, so the figure on the application should cover the electrician, plumber and other trades as well as the carpentry. Residential electrical work is priced by job type: new construction on the projected building cost from the building permit, alterations by fixture count, services by overhead or underground, and solar up to 10 kW at a flat rate. Buildings with three or more units pay the commercial electrical rate. A homeowner can apply for a building permit for work on their own one- or two-family house under the state code’s homeowner rule; paid work is supervised by a Construction Supervisor License holder, and contractors on existing owner-occupied homes of one to four units must be registered Home Improvement Contractors with the state.

Commercial permits

Commercial projects use the same building fee formula, so a larger job simply carries more $1,000 steps. Commercial electrical permits start at $350 for the first $100,000 of new construction, and plumbing and gas fixtures cost twice the residential rate per fixture. Work started without a permit costs a commercial electrical or plumbing applicant $300, double the residential penalty.

What comes before the building permit

  • Zoning. The Zoning Ordinance governs use, dimensions and, for fences, sight lines; the Zoning Board of Appeals hears variances and the Planning Board handles its own permits.
  • Conservation Commission. Work under the Wetlands Protection Ordinance, Chapter 6.5, Article II, including every new or largely repaired fence on Plum Island.
  • Board of Health. Septic systems under Title 5 and other health permits go through the city’s Health Department and Board of Health.
  • Flood zones. The Building Department links FEMA’s Map Service Center so applicants can look up the flood map for a lot before design.
  • Planning & Development. Its permitting and maps page is the starting point for land-use questions.

Newburyport permit costs and fees

The building permit fee on the department’s Building Permit Fees page is a single formula based on the total building cost, all trades included: a $50 base fee that covers the first $1,000, plus $10 for each additional $1,000, rounding up. The page prints no date. Trade fees come from the electrical sheet updated in 2023 and the plumbing and gas sheet dated 2021.

Trade permits and who may pull them

  • Electrical. Filed by a state-licensed electrician. The electrical inspector takes calls at (978) 465-4464 ext. 1704 on Tuesdays and Thursdays and inspects on those days from 8:00 am to 2:00 pm.
  • Plumbing and gas. Separate permits for plumbing and for gas, filed by a licensed plumber or gas fitter, each with a $40 permit fee and a $45 inspection fee before fixture charges. Calls go to (978) 465-8835 from 7:00 to 8:00 am, Monday to Thursday, and inspections run on Mondays, Wednesdays and Thursdays.
  • Sheet metal. Its own permit and fee sheet; the inspection is booked through the Building Department.

The 2021 sheet lists a replacement water heater under both the plumbing fees and the gas fees, at $60 each for a house and $75 for commercial work, and the electrical sheet charges $65 for central heat or air conditioning in a home.

How to apply for a Newburyport building permit

1. Check the land-use rules

Look at the Zoning Ordinance, the flood map and, near wetlands or on Plum Island, the Wetlands Protection Ordinance.

2. Get board approvals first

Conservation Commission, Zoning Board of Appeals, Planning Board or Board of Health as the job requires.

3. Price the whole job

Total the building cost with all trades included; that figure sets the building fee.

4. Apply

Use the Online Permitting link on the Building Department page, or call (978) 465-4405 with questions.

5. Add trade permits

The electrician, plumber and gas fitter file their own permits under the trade fee sheets.

6. Book inspections ahead

Call the department or schedule online; same-day inspections are not offered.

Review, corrections and what causes delay

The State Building Code (780 CMR 105.3.1) gives the building official 30 days from the filing of an application to issue the permit or deny it in writing with the reasons. A Newburyport file can also wait on things outside the building code itself: a Conservation Commission decision that is still pending, a fence or addition that does not meet the zoning sight-line or dimensional rules, or a construction cost that leaves out trade work and has to be restated.

Electrical permits include a set number of inspections (three for new construction and pools, two for alterations and generators, one for services and solar), and any extra or failed visit costs $45. The final building inspection leads to the certificate of occupancy for new buildings and changes of use.

Massachusetts building code in Newburyport

Newburyport enforces 780 CMR, 10th edition, and has adopted the Opt-In Specialized energy code in 225 CMR, so new construction and the renovations it covers are designed to that code rather than to the base energy code. The department has posted a news item on the move to the tenth edition.

Massachusetts has one State Building Code, 780 CMR, for every city and town; towns cannot rewrite it, though many opt into a stricter energy code. The trades run under their own state codes. Massachusetts rules
