In Millbury, the Building Department at 127 Elm Street (508-865-0438) issues building permits and the wiring, plumbing and gas permits, with applications filed through the town’s OpenGov portal. Under the fee schedule revised January 27, 2026, a one- or two-family dwelling costs $9 per $1,000 of construction cost with a $150 minimum, all fees are due when you apply and none are refunded, and work started without a permit is charged triple.

What requires a building permit in Millbury?

Millbury, a Worcester County town of about 14,300 people, keeps its building, wiring, plumbing and gas fees on one schedule, and that schedule is the clearest local list of what the department permits.

Building permit

  • New one- and two-family dwellings, additions and renovations
  • Commercial construction and new business occupancies
  • Decks (the department posts a deck template), sheds, and in-ground or above-ground pools
  • Wood, pellet and coal stoves, filed online as a Solid Fuel Burning Permit Application
  • Sheet metal and mechanical work
  • Temporary and permanent signs, tents and temporary trailers

Other permits and requests

  • Wiring, plumbing and gas permits, each priced separately
  • A $100 zoning determination request, filed online
  • Certificates of inspection for places with liquor licenses and for buildings of three or more units
  • Planning Board stormwater management permits and site plan review

The Zoning Bylaw (Title 18 of the Municipal Code) adds siting rules that apply whether or not a building permit is needed. Under Section 32.9, every accessory structure, including in-ground and above-ground pools, hot tubs and spas, sheds over 120 square feet and decks, must meet the minimum yard setbacks for its district. Section 32.12 bars a building permit for new construction on an odd-shaped lot whose regularity factor (16 times the land area divided by the square of the perimeter) is below 0.4, and the bylaw also keeps visual obstructions such as opaque fences and hedges out of the 2½- to 8-foot sight line within 20 feet of a street intersection.

The schedule says nothing about exempt work. For a small job, call the office before starting, since work done without a permit is charged three times the normal fee.

What Millbury decides and what the state holds

The State Building Code, 780 CMR, is written by the Board of Building Regulations and Standards and enforced in Millbury as written. The town’s own Municipal Code adds three things: the Town Manager appoints the inspector of buildings each year as head of the Building Department (Section 15.05.020); the Board of Selectmen sets and revises the permit fees (Section 15.05.030); and Chapter 15.20, adopted as Bylaws Article 20 on June 7, 2011, puts the Stretch Energy Code, as amended from time to time, in place of the base energy provisions. The Municipal Code on eCode360 includes legislation through May 6, 2025.

Millbury permit types and forms

Applications are made in OpenGov, where the Building Department also takes zoning determination requests. The department’s document list covers what most applications need: a homeowners authorization, a homeowners exemption eligibility affidavit for owners doing their own work, a workers’ compensation affidavit, information on hiring a contractor, a deck template and a completed work affidavit.

Residential permits

A one- or two-family dwelling permit is $9 per $1,000 of construction cost with a $150 minimum and includes up to eight inspections; each additional inspection is $75. Smaller items are flat: $100 for a shed, an above-ground pool or a wood, pellet or other solid-fuel appliance. An in-ground pool is $9 per $1,000 with a $200 minimum. Residential sheet metal and mechanical work is $9 per $1,000 with a $150 minimum.

Commercial permits

Commercial construction is $12 per $1,000 with a $200 minimum, and commercial sheet metal or mechanical work is priced the same way. A new business occupancy is $100. The department posts certificate of inspection applications for alcoholic beverage licensees and package stores and for other occupancies, plus information for new or existing multi-family buildings of three or more units; a certificate of inspection costs $200, and a movie theater pays $200 plus $10 for each theater.

What comes before the building permit

  • Zoning. The Board of Appeals hears appeals under Chapter 40A and grants the special permits listed in Section 14 of the Zoning Bylaw and variances. The Planning Board administers the subdivision rules, site plan review, stormwater management permits and certain special permits. A zoning determination can be requested online for $100. The Zoning Bylaw requires the inspector of buildings to certify zoning compliance before a building is erected, substantially altered, moved or changed in use, and for development that triggers site plan review, no building permit can issue until the Planning Board approves the site plan.
  • Conservation Commission. Work in or near wetlands is filed with the Commission under the state Wetlands Protection Act; its office posts checklists for a Notice of Intent, an Abbreviated Notice of Resource Area Delineation and a Request for Determination of Applicability (508-865-5411).
  • Board of Health. The Board of Health issues well construction and well decommissioning permits under its own well regulations, and septic systems come under Title 5 through the same office (508-865-4721).
  • Floodplain. The department links the state’s MassMapper flood layers so owners can see whether a lot is in a mapped flood zone.

The Planning Board’s own fee schedule (adopted July 11, 2005, last revised September 12, 2023) sets minimum fees, paid by check to the Town of Millbury, and lets the board ask for more when a review needs it. Site plan review is $500 plus $20 per parking space (up to $7,500), $50 per dwelling unit or $10 per linear foot of a wireless facility’s height, with a $100 legal advertisement fee and a technical review fee of up to $6,000. A stormwater management permit is $200 to file, with a technical review fee of $1,800 for up to 2 acres or $3,000 above that. An Approval Not Required plan is $150 plus $50 for each new building lot and $10 for each new survey point; unused technical review money is refunded after the project is finished or denied.

Zoning changes are pending: the warrant for the Special Town Meeting on November 12, 2026 includes zoning articles on solar photovoltaic installations, an amendment to the Floodplain District, off-site parking and two split-zoning fixes.

Millbury permit costs and fees

Under Section 15.05.030 of the Municipal Code, the Board of Selectmen sets the permit fees; the posted schedule was revised on January 27, 2026. All fees are due at the time of application and are non-refundable.

Review, corrections and what causes delay

Under 780 CMR 105.3.1 the building official must act on an application within 30 days of filing. Millbury’s department page warns of an extremely high demand for inspections, and same-day inspections are not offered. A failed or missed inspection also adds a step: the $75 re-inspection fee has to be paid before the next inspection can be booked, and it is done by the inspector who failed the work.

Inspections in Millbury

All inspections are requested through the Building Department office at 508-865-0438, and same-day inspections are not possible. Each trade has fixed windows:

  • Building: Monday to Friday, 1:00 to 4:00 pm.
  • Electrical: Monday, Wednesday and Friday, 2:00 to 4:30 pm.
  • Plumbing and gas: Monday, Wednesday and Friday, 8:30 to 10:30 am.

Inspections are not done on state or federal holidays or days Town Hall is closed, and snow must be cleared from a roof before a building or electrical inspection. Solar installations have their own routine: the rough electrical inspection is replaced by photos uploaded for review (racking and bonding, the attic where it applies, grounding, the water service and bond, taps, and the inside of every disconnect, box and panel), while trench inspections still need a site visit. Every solar project needs a final electrical inspection before the final building inspection, and no Certificate of Completion is issued until both finals have passed.

Building code and local bylaws in Millbury

Millbury builds to 780 CMR, 10th edition, with the Stretch energy code adopted under Chapter 15.20 of its Municipal Code. The Municipal Code also divides the town into fire districts for the building code, with Fire District No. 2 covering the Business A or B II and Industrial A or B II zoning districts, and it has no demolition delay chapter. FEMA lists Millbury as a participating community in the National Flood Insurance Program, with flood maps effective June 21, 2023.
