What requires a building permit in Dracut?

Dracut’s Building Department states the rule in the state code’s terms: a permit is needed to construct, reconstruct, alter, repair, remove or demolish a building or structure, or to change its use or occupancy. The department issues permits for all public and private buildings, alterations, additions, pools and garages, and it also does periodic inspections of businesses and issues zoning determinations.

Permit needed

  • New homes and commercial buildings, additions and renovations
  • Garages, decks, pools and sheds of 120 square feet or more
  • Demolition
  • Wiring, plumbing, gas and sheet metal work, each on its own permit
  • Wall, ground and electronic signs, and A-frame sidewalk signs (yearly)
  • Driveway enlargement or repaving, through the Stormwater Department in ViewPoint

Town’s exempt list

  • Ordinary repairs
  • Fences 6 feet high or less, if entirely on your own land
  • Retaining walls under 4 feet high
  • One-story detached sheds and playhouses smaller than 10 by 12 feet (under 120 square feet)

Two zoning limits ride along with the exemptions. A shed that needs no building permit must still sit at least 30 feet from the front lot line and 10 feet from the side and rear lines, and a fence within 35 feet of a street intersection may be no higher than 42 inches above grade, a sight-line rule the Police Department enforces.

What Dracut decides and what the state holds

The building code is the Commonwealth’s 780 CMR, now in its 10th edition, written by the Board of Building Regulations and Standards; the town enforces it but cannot amend it, and the exemption list in the code (780 CMR 105.2) is the legal baseline behind the town’s short list above. The department also enforces the state sheet metal rules in 271 CMR and the Architectural Access Board rules in 521 CMR.

Dracut’s own layer is its Zoning By-law (updated effective November 7, 2022), the Town By-Laws (amended through the November 10, 2025 Annual Town Meeting), the wetland bylaw and regulations, the stormwater and erosion control bylaw, and the fee schedule. Town Meeting adopted the Stretch Energy Code as Chapter 27 of the bylaws on June 4, 2018 (Article 39), effective July 1, 2018, and the department still describes Dracut as a Stretch Code community. Chapter 9A adds a local rule: no building permit issues for a house on a new street, or an extension of one, until water, sewer, drainage, gas, electric, telephone and service connections are installed to the lot line and each utility has confirmed it in writing.

Dracut building department: who handles permitting

The Building Department, led by Building Commissioner Gregory Williams, issues the permits, inspects the work, enforces the Zoning By-law and investigates code and zoning complaints. Its Wiring Inspector and Plumbing & Gas Inspector issue and inspect the trade permits for all non-utility wiring, plumbing and gas work in town.

Dracut permit types

Dracut’s required paperwork for a building permit is short and specific: the online application, a certified plot plan, complete building plans, energy code information, engineering specifications for LVLs, steel and similar members, the Construction Supervisor License, the Home Improvement Contractor registration and a workers’ compensation insurance certificate. The department reminds applicants that the application is a legal document that must be filled out accurately and completely.

Residential permits

Most residential questions in Dracut are zoning questions first, and the department publishes short guides for the common cases: an overview of residential development, building a home on an undeveloped way, pre-existing nonconforming houses, demerged lots and small lots. A small-lot submission review costs $500. New homes and additions follow a published stage-by-stage inspection list, starting with excavation and ending with a final building inspection that includes the energy certificate. A homeowner may pull a permit for their own one- or two-family home under the state code’s homeowner rule; otherwise a licensed construction supervisor is named, and a contractor working on an existing owner-occupied home of one to four units must be HIC-registered.

Commercial permits

Commercial building and fit-up permits use the same $12 per $1,000 rate as homes, and a commercial certificate of occupancy is $100. Projects that need site plan approval or a special permit go through the Community Development Director, who advises the Planning Board and the Board of Selectmen on those applications, and the recorded decision or approved site plan is part of the building permit file. The Wiring Inspector also certifies inspections of schools, public buildings, day care centers, nursing homes, licensed premises, hotels, multi-family buildings and places of assembly, and enforces fire alarm rules in new and renovated buildings.

What comes before the building permit

  • Zoning Board of Appeals. Variances, Chapter 40B comprehensive permits, special permits for altering one- and two-family homes, and appeals of the Building Inspector’s decisions. A recorded variance, special permit or finding goes in with the application.
  • Planning Board. Special permits, site plans and subdivision approvals; a signed lot release or recorded ANR plan is needed for new lots.
  • Conservation Commission. Any activity within 100 feet of wetlands, ponds or intermittent streams, or 200 feet of a perennial stream, is reviewed under the Wetlands Protection Act and Dracut’s wetland bylaw, by administrative approval, an RDA or a Notice of Intent. An Order of Conditions must be recorded at the Middlesex North Registry of Deeds, and proof of recording brought back, before work starts.
  • Board of Health. Septic systems on unsewered lots follow Title 5 through the Dracut Board of Health and its Health Department.
  • Sewer and streets. Sewer work is done by drain layers on the Sewer Department’s authorized list; new streets need every utility installed before house permits issue.
  • Historic review. Dracut’s bylaws, as amended through November 2025, contain no demolition delay chapter.

Dracut permit costs and fees

The Building Department’s fee sheet is effective July 1, 2023. Cost is the contract amount plus change orders, or the Building Inspector’s own figure from an industry cost guide such as RSMeans.

A $90,000 addition, for example, carries a $1,080 building permit (90 × $12) and a $50 occupancy certificate, with the wiring and plumbing permits priced separately on the cost of that work. Building fees are set by vote of the Board of Selectmen. The Town By-Laws book (amendments through November 10, 2025) still records only the vote effective February 3, 2015, at $10 per $1,000 with a $35 house occupancy certificate; the department’s July 1, 2023 sheet is its current published schedule and is the one used here.

Wetland filings have carried local fees since February 1, 2026: $50 for a Request for Determination of Applicability, $55 per Category 1 activity (such as an addition or pool on a house lot) and $250 per Category 2 activity (such as building a single-family house) on a Notice of Intent, capped at $750 for a single-family residence, plus a $150 legal advertisement. These are on top of the state wetland fee.

Trade permits and who may pull them

  • Wiring: the Wiring Inspector enforces 527 CMR 12 and grants electrical permits only to holders of Commonwealth electrical or systems licenses. Inspections are scheduled weekly and need 24 hours’ notice.
  • Plumbing and gas: the Plumbing & Gas Inspector enforces 248 CMR and the fuel gas code, reviews plumbing in new and renovated buildings, and permits and inspects all non-utility plumbing and gas fitting for licensed plumbers and gas fitters.
  • Sheet metal: permitted by the Building Department under 271 CMR.
  • Smoke and CO detectors: the final detector inspection on a new home or addition is done by the Fire Department.

Plumbing, gas and wiring each cost $20 per $1,000 of the trade work, so on a large job the trade permits can together exceed the building permit.

How to apply for a Dracut building permit

1. Read the zoning guides

Check the lot against the Zoning By-law and the department’s guides on small, demerged and nonconforming lots; request a zoning determination if in doubt.

2. Get board approvals recorded

ZBA variance or special permit, Planning Board site plan or ANR plan, and any Conservation Order of Conditions, recorded at the Middlesex North Registry.

3. Assemble the package

Certified plot plan, full plans, energy code information, LVL and steel specifications, CSL, HIC and workers’ compensation certificate.

4. Apply in ViewPoint Cloud

Create an account at dracutma.viewpointcloud.com, choose the permit and upload the documents.

5. Pay and receive the permit

Fees are $12 per $1,000 for building work; start nothing before issuance, or the fee doubles.

6. Trade permits and inspections

Licensed trades file their own permits; follow the inspection list stage by stage.

Review, corrections and what causes delay

The state code gives the building official 30 days from the application to issue or refuse the permit in writing (780 CMR 105.3.1). In Dracut the usual reasons a file stalls are zoning, not construction: an undersized or demerged lot that needs the $500 small-lot review, an addition to a nonconforming house that needs a ZBA special permit, a missing recorded decision, or a house on a new street whose utilities are not yet signed off.

Inspections in Dracut

For new homes and additions the department publishes the inspection order: excavation; footing and foundation (with damp proofing, the perimeter drain and any insulation); a certified as-built plot plan before framing begins; the exterior air barrier and flashing before siding; rough electrical once the siding is on; rough plumbing and gas; rough smoke and carbon monoxide detectors; fire and draft stopping; rough HVAC and duct test; rough frame; insulation; and finals for electrical, plumbing and gas, smoke and CO (by the Fire Department) and building, including the energy certificate. The rough detector, fire and draft stopping, HVAC and frame inspections may be combined into one site visit.

A failed or missed inspection costs $50 to repeat. The occupancy certificate ($50 for a house, $100 commercial) closes the job.

Massachusetts building code

Dracut enforces the 10th edition of 780 CMR with the Stretch Energy Code. FEMA’s Community Status Book lists the Town of Dracut (community 250190) as a participating National Flood Insurance Program community, with flood maps current from July 8, 2025; the town posts east and west map comparisons and keeps the official maps at Town Hall, and the floodplain is a layer in the Dracut GIS.

Dracut permit search and official resources

ViewPoint Cloud holds the town’s online permit and inspection records. For a property’s history, the Building Department keeps as-built plot plans for most new construction and additions back to about the 1980s and will email copies on request; older permit files can be asked for through a public records request to the Town Clerk’s office, in person, by mail to Town Hall or on the online form.
