In unincorporated Allen County, building permits come from the county’s Planning and Zoning Administrator at the Allen County Courthouse, 1 N. Washington, Iola (620-228-1621). The permit checks the project against the county zoning and floodplain regulations, and a home on a septic system or lagoon also needs a county sanitary permit before building starts. The cities of Iola, Humboldt, Moran, Gas and La Harpe issue their own building permits.
What needs an Allen County permit?
The county’s one-page building permit application covers three kinds of work on rural land: new construction, additions and alterations. It asks which zoning district the land is in (agricultural, commercial, residential or industrial) and whether the project needs a zoning change, so a use the district does not allow goes through rezoning or a conditional use permit first.
County permit or approval
- New houses, farm and accessory buildings, commercial and industrial buildings
- Additions to and alterations of existing buildings
- Septic tanks, lagoons and other private wastewater systems (sanitary permit)
- Water wells (county environmental protection office)
- Building in a mapped flood hazard zone (floodplain development permit)
- Rezoning and conditional uses (zoning board hearing, then the County Commission)
Other approvals
- New entrances and culverts on county roads must meet county guidelines
- A road or drive crossing with 160 acres or more of drainage above it needs Kansas Division of Water Resources approval
- Structures taller than 50 feet must be set back 1.1 times their height (Resolution 202305)
- Commercial solar and battery energy storage systems have their own county zoning rules

The Planning and Zoning Administrator, Terry Call, runs the county zoning office. The county’s guide for rural newcomers says the office reviews building permit applications and issues the permit when the zoning and floodplain regulations allow the project, and that the same office acts as the Local Environmental Protection office for sanitary permits. The Allen County Planning Board, whose members the County Commission appoints, holds the zoning hearings and makes recommendations; the Commission decides.

Private wastewater systems are permitted by the county zoning office in its role as the Local Environmental Protection office. The Sanitary Permit Application covers new, modified and replacement systems, including lagoons, septic tanks with rock-and-pipe laterals or gravelless chambers, mound, pressure and aerobic treatment systems. It asks for the lot size, the expected monthly water use, the home’s size, bedrooms, bathrooms and occupants, the tank’s capacity and manufacturer, and the contractor who will install it. On the back you draw the system with all its dimensions, including the lateral field, and the distance to any structure, property line, water line, well or stream within 200 feet. The county posts the KDHE minimum standards for wastewater systems and the list of KDHE-approved septic tanks with the form.
The county’s published forms do not set up separate county electrical, plumbing or mechanical permits for rural land. Inside Iola, the city licenses contractors and individual tradespeople and issues the trade permits; the other cities list trade work on their own building permit forms.
Allen County permit fees
Allen County publishes no fee for its building permit or its sanitary permit: neither county form lists one, and the building form asks only for the estimated cost of the improvements. Call the Zoning Administrator (620-228-1621) for the current charge before you file. City permits are priced by each city.

How to get an Allen County building permit
Inside Iola, Humboldt, Moran, Gas or La Harpe, apply at that city instead.
Use the county zoning map. If the use is not allowed, ask the Zoning Administrator about a rezoning or conditional use permit, which goes to a Planning Board hearing and then to the County Commission.
On land without sewer, the septic or lagoon system must be approved by the county before you begin to build.
A site in a flood hazard zone needs a floodplain development permit, and a new entrance or culvert must meet county guidelines.
Bring or send the completed form and drawing to the Zoning Administrator at the courthouse, Monday to Thursday.
A private water well is permitted by the county’s environmental protection administrator, not by the building permit.

The sanitary permit form has a section for a lender’s loan inspection, and the county’s guide for rural newcomers says the environmental protection administrator checks septic sites before a system is installed. The county’s building permit is a zoning and floodplain approval; the county lists no structural or trade inspections for rural buildings. Inside the cities, each city’s inspector checks the work; the City of Gas, for example, lists site, footing, foundation, under-floor plumbing and framing inspections in its building guide.
Local rules that matter in Allen County
Zoning hearings: rezoning and conditional use requests are heard by the zoning board, which makes a recommendation; the County Commission then votes. In January 2026, for example, the Commission approved an agricultural-to-commercial change for contractor and RV storage after the board’s hearing.
Tall structures: since Resolution 202305 (2023), a structure taller than 50 feet must be set back at least 1.1 times its height.
Energy projects: the county has zoning regulations for commercial solar energy systems, and the Commission adopted battery energy storage system regulations by Resolution 202505 in June 2025, after a temporary moratorium under Resolution 202502.
Floodplain and water: construction in a flood hazard zone needs a floodplain development permit from the county floodplain manager, and a crossing that drains 160 acres or more needs Kansas Division of Water Resources approval.
Kansas building code
Kansas has no general statewide building code: each city and county adopts and amends its own. A few state rules apply everywhere, led by the Kansas Fire Prevention Code. Kansas rules
