Neosho County, Kansas Building Permit Guide

Neosho County has no county zoning; outside the cities it requires a floodplain development permit for work in mapped flood zones and a wastewater application ($50 per parcel) for septic systems and lagoons, while Chanute issues its own building permits.

Neosho County has no zoning, and for unincorporated land its permits cover two things: a floodplain development permit from the GIS / Floodplain office in the Erie courthouse (620-244-3801) for any development in a FEMA Special Flood Hazard Area, and a wastewater application, with a one-time $50 fee per parcel, before a septic system or lagoon is built. Chanute permits construction inside its city limits.

What needs a county permit in Neosho County?

The county has not adopted zoning; a June 2026 resolution says the commission is still weighing whether to adopt a comprehensive plan and zoning. What the county does regulate in its unincorporated area:

Floodplain development permit

  • Any development in a Special Flood Hazard Area: new buildings, additions and substantial improvements
  • Fill, grading, paving, excavation and drilling
  • Levees, mining, dredging and land clearing such as tree removal
  • Storage of equipment or materials in the flood zone

Other county approvals

  • Wastewater application for a new, repaired or enlarged septic system or lagoon
  • A 911 address for a new home, from the GIS office
  • A culvert or field entrance on a county road, installed by Road & Bridge

The county does not issue electrical, plumbing or mechanical permits.

Who issues permits in Neosho County?

The GIS / Floodplain office (Suite 14, Neosho County Courthouse, 100 S. Main St., Erie; 620-244-3801; weekdays 8 a.m. to 4:30 p.m.) is the county’s floodplain manager and assigns 911 addresses. Wastewater systems fall under the county Sanitary Code, administered by the county’s lagoon and sewer inspector (Sanitation office, 620-794-3870). Road & Bridge, 515 E. 4th St., Erie (620-244-3855), installs culverts. Inside the cities:

Septic systems and lagoons

The Neosho County Sanitary Code applies to all unincorporated land, whatever its ownership or acreage. Only installers holding a Neosho County installer licence may install or repair an onsite wastewater system, and licences run to December 31 each year.

Start with the county’s Wastewater Application, available online or at the Appraiser’s Office. It asks for the acreage, whether the site is in the 100-year floodplain, whether it is new construction, a repair or an addition, the number of bedrooms (or estimated water use for commercial sites), the installer, and the tank, lateral or lagoon details. Attach a legible design plan with a north arrow, system dimensions, setbacks, property lines, roads, utilities and easements. The wastewater sanitarian then calls to arrange a site visit.

  • Lot size: 3 acres is the minimum for a wastewater system; a smaller lot can use a holding tank that is pumped when full.
  • Tank size: 1,000 gallons for 1–2 bedrooms, 1,200 for 3, 1,500 for 4–5 and at least 2,000 for 6 or more.
  • Laterals: 150 feet per bedroom with rock and pipe, or 120 feet per bedroom with chambers.
  • Setbacks: a tank or absorption field must be 10 feet from property lines and habitable buildings and 100 feet from a drinking-water well; a lagoon must be 50 feet from property lines and homes and 100 feet from a well.
  • Lagoon fence: 48-inch woven wire or chain link outside the berm, with a gate at least 4 feet wide.

What a floodplain permit needs

The floodplain development permit application covers the owner or developer, the site, parcel number and acreage, the type of work (new construction, substantial or minimum improvement, fill, grading or excavation), the estimated cost including donated labor and materials, and the value of any existing structure. Attach:

  • A site plan showing the project, the floodplain boundaries and elevations (always required)
  • A FEMA Elevation Certificate by a licensed land surveyor or professional engineer, for new buildings and substantial improvements
  • A floodway no-rise certification with hydrologic and hydraulic analysis, for work in a regulatory floodway
  • A dry floodproofing certificate for some non-residential buildings

Work on an existing building counts as a substantial improvement when its cost reaches 50% of the building’s value. Some projects also need a permit from the Kansas Department of Agriculture, Division of Water Resources, which the county asks you to check first.

How to build in rural Neosho County

1. Check city limits

Inside Chanute, apply to the City; inside the smaller towns, ask the city clerk.

2. Check the flood map

Ask the GIS / Floodplain office whether the site is in a Special Flood Hazard Area before you design.

3. Get the floodplain permit

If it is, file the floodplain development permit with a site plan and elevation information; no work may start until it is issued.

4. Apply for the wastewater system

Return the wastewater application, design plan and $50 fee to the Appraiser’s Office, and hire a county-licensed installer.

5. Arrange the driveway and address

Ask Road & Bridge to install the entrance culvert, then send the 911 Address Request Form to the GIS office.

6. Finish to the approved plans

A building in the flood zone needs a finished elevation certificate.

County inspections

There are no county building inspections. The wastewater sanitarian makes an onsite visit for each wastewater application, and the floodplain manager may enter land to check that development in the flood zone complies; a structure in the flood zone without a permit is presumed to be in violation until the owner shows otherwise.
