Cherokee County, Kansas Building Permit Guide

Outside the cities, Cherokee County requires a Construction Application Permit filed with the County Appraiser’s office in Columbus, plus floodplain and septic permits from Emergency Management; Columbus, Galena and Baxter Springs issue their own building permits.

In unincorporated Cherokee County, every new house, manufactured home, storage building, commercial building or cell tower needs a county building permit, issued through the County Appraiser’s 911 mapping office at the courthouse in Columbus (620-429-9500, ext. 3). The application costs $25 for non-commercial work and $50 for commercial work under Resolution No. 07-2018, and farm buildings need a permit at no charge. Floodplain and septic permits come separately from the county’s Emergency Management department.

What needs a county permit in Cherokee County?

Resolution No. 07-2018 sets out the county’s permit categories for land outside city limits. A 911 address and proof of ownership must accompany each building or floodplain application.

Permit required

  • New site-built houses and storage buildings not used for farming
  • Modular, mobile and manufactured homes
  • Commercial buildings and cell towers
  • Agricultural buildings (permit before construction, no fee)
  • New construction and additions in a mapped floodplain (separate floodplain permit)
  • New or rebuilt septic and lagoon systems

No permit under the resolution

  • Decks
  • In-ground pools

The county’s current Construction Application Permit form also lists sheds, demolition and solar panels among the construction types to tick, so describe that work on the form as well.

Who issues permits in Cherokee County?

The 2018 resolution gives the county’s 911 mapping department the job of issuing all building permits for unincorporated land, and the County Appraiser’s office now handles addressing for that area. Applications go to the County Appraiser, PO Box 352, Columbus, KS 66725, or the Appraiser’s counter in the courthouse (620-429-9500, ext. 3). The same resolution moved septic and private sewer enforcement from the Health Department to Emergency Management.

Emergency Management is also the county floodplain administrator. Its office is at 110 W. Maple St., Columbus (mail to PO Box 143), phone 620-429-9500, option 8; Lyle Grandy is the Emergency Management Director.

Neither the 2018 resolution nor the county’s construction application refers to a building code or to structural inspections. Inside city limits the cities, not the county, are responsible:

Septic systems and trade work

Private wastewater systems in the unincorporated county are permitted by Emergency Management. The 2026 Wastewater System Permit asks whether the job is a new installation or a reconstruction, the system type (conventional, lagoon or other), bedrooms and acreage for a home, and any extra water use such as a home business or day care. A licensed contractor must supply a detailed drawing of the whole system, and any change to the approved plan must be approved before installation. The county posts its list of septic contractors on the Sanitarian page.

The form sets these minimum distances: 10 feet from a property line (50 feet for a lagoon), 20 feet from the house foundation (50 feet for a lagoon), 10 feet from a private water line and 25 feet from a public water line. Properties in County Sewer Districts 1 and 2 are served through Road & Bridge, 620-317-1153.

Cherokee County permit fees

Fees come from Resolution No. 07-2018, which repealed Resolution 03-2018. The 2026 septic permit form and the floodplain permit form repeat the same amounts.

Cherokee County permit fees (Resolution No. 07-2018)
ItemFee
Building permit application, non-commercial (houses, storage, modular and manufactured homes)$25
Building permit application, commercial$50
Cell tower$50
Agricultural building$0 (permit still required)
Floodplain permit, new construction or addition$50
Septic permit, new construction$40
Septic permit, reconstruction$30
Contractor septic permit application fee$20
Septic contractor application and annual licence$60
Sewage system re-inspection for resale$150
Septic hauler licence and annual inspection$50

If the county sends a written notice that a required permit is missing, the owner has 30 days to comply; after that the application and permit fees double, and unpaid fees can be certified as a special assessment on the property. A contractor who starts new or rebuilt septic work without filing the permit and licence with Emergency Management is charged $10 for every 30 days of delay.

What the county application needs

  • Parcel ID and quarter-section reference, the construction address and the owner’s mailing address
  • Contractor name, address and phone
  • Estimated improvement cost and construction type
  • For a home: bedrooms, bathrooms and estimated square footage; for a commercial building: type, square footage and whether plans are included
  • Signatures of the owner or agent and the contractor
  • A 911 address and proof of ownership
  • For a manufactured home: proof of title showing it was built in 1976 or later, and proof of a licensed installer

Staff record the acreage and flood zone on the form and note whether the property is in the Neighborhood Revitalization Plan. Under the resolution, owners must tell the county before moving a manufactured, mobile or modular home into Cherokee County, and the home must have been built after June 15, 1976 to the federal manufactured home construction and safety standards. Septic applications need their own site plan.

How to get a building permit in rural Cherokee County

1. Confirm the jurisdiction

Check that the site is outside city limits; inside Columbus, Galena or Baxter Springs, apply to the city.

2. Get a 911 address

The County Appraiser’s office assigns addresses for unincorporated land and needs one for the application.

3. Complete the Construction Application Permit

Fill in the parcel, owner, contractor and project details and sign it; add proof of ownership and, for a manufactured home, title and installer proof.

4. Add floodplain and septic permits

If the site is in a flood zone, file the floodplain development permit with Emergency Management; for a new or rebuilt septic system, file the Wastewater System Permit with a contractor’s drawing.

5. Return and pay

Send the building application to the County Appraiser, PO Box 352, Columbus, with the fee; the form notes that permits are processed in the order received.

County inspections

The county’s permit documents call for septic work to follow the Cherokee County Environmental Code, with plan changes approved before installation; the resolution also charges $150 for a sewage system re-inspection when a property is sold. In a mapped floodplain, the floodplain administrator keeps a record of the elevation of each new or substantially improved building’s lowest floor. Framing, wiring and plumbing inspections are not listed in the county’s permit documents for rural property.
