New York City is the largest city in the United States, about eight and a half million residents across the five boroughs of Manhattan, Brooklyn, Queens, the Bronx and Staten Island. What requires a building permit in New York City?

New York City is the one place in the state that does not run on the statewide Uniform Code. The city is carved out of it entirely and enforces its own New York City Construction Codes — a building, plumbing, mechanical, fuel gas and electrical code set maintained by the city and administered by the Department of Buildings through its borough offices, not by the Department of State. So the first question in New York City is not which town or village holds jurisdiction, as it is elsewhere in the state, but which Department of Buildings work type and filing representative your project needs. The Department of Buildings administers the New York City Construction Codes, most recently updated in the 2022 edition, through its borough offices rather than the statewide Uniform Code.

The definition of an ordinary repair is narrower than owners expect, and an exemption from a Department of Buildings permit is never an exemption from the Zoning Resolution, the fire code, or the energy code. The city layers that apply on top of the base codes

Several New York City layers routinely catch projects owners assume are simple: the New York City Energy Conservation Code, the city’s own energy code rather than the state ECCCNYS; Local Law 154 of 2021, which bars most fossil-fuel combustion in new buildings and makes new construction effectively all-electric on a phased schedule; and, for larger existing buildings, the emissions limits of Local Law 97. Sidewalk-shed and facade-inspection obligations, and flood-zone construction standards in coastal and waterfront areas, apply on top again.

Most filings go through the department’s electronic system and are submitted by a licensed professional. Residential contractors performing work over two hundred dollars need a Home Improvement Contractor licence from the Department of Consumer and Worker Protection, and general contractors on larger jobs register separately with the Department of Buildings.

Electrical and plumbing work files under a licensed master electrician or master plumber, credentialed by the department itself. A licence from a neighbouring county carries no weight inside the city.

Permit types

Residential permits

Residential work is filed with the Department of Buildings under the New York City Construction Codes and the New York City Energy Conservation Code. Small cosmetic work such as painting and flooring is generally an ordinary repair, but the definition is narrow and alterations affecting egress, structure or systems need a permit. Local Law 154 applies to new buildings and qualifying gut renovations.

How New York contractor credentials work

New York does not license general contractors at state level. There is no state contractor licence, no state exam and no state board for general contracting. Licensing is a city and county matter, and the requirements change as you cross a municipal line. The state regulates home improvement contract terms through General Business Law Article 36-A rather than licensure, so a written contract obligation can apply even where no licence does.

In New York the licence lives with the locality, not the state. A registration issued by one county does not authorise work in the next, and a contractor working across the metropolitan region routinely holds several at once. Commercial permits

Commercial work is filed under the New York City Construction Codes with plans stamped by a New York-licensed architect or engineer, and routes through the department’s plan examination. Place-of-assembly, facade, sprinkler and elevator work carry their own filings, and Local Law 97 emissions limits apply to larger existing buildings.

Licenses, trade classifications and design professionals

Practically, three credential layers appear on New York projects: the local home improvement or contractor registration where the jurisdiction issues one; separately licensed electrical and plumbing trades, licensed locally rather than statewide; and, on commercial and larger residential work, drawings stamped by a New York-licensed architect or professional engineer. New York does not layer a uniform statewide permit surcharge on local charges the way some states do, so the fee is substantially local: each city, town and village sets its own schedule by local law, and neighbouring municipalities on the same road can price the same job differently. Trade permits and who may pull them

In New York City the trades run on the city’s own construction codes and on Department of Buildings licences, not on the statewide books. Electrical and plumbing work is filed under a licensed professional who takes personal responsibility for it, and the trade permit generally cannot be issued until the associated work is properly filed.

How to apply for a New York City building permit

Review, corrections and what actually causes delay

In New York, the first cause of delay is uncertainty over jurisdiction — filing with a town when an incorporated village inside it holds the authority, or assuming a county issues permits when it generally does not. After that come Energy Code documentation, a contractor registration that the jurisdiction does not recognise, and, in shoreline and flood-prone areas, floodplain requirements that were not addressed up front. Build the plan-review time into the schedule and confirm the checklist with the Department of Buildings before filing.

Approvals do not stay live indefinitely. A New York building permit carries a validity period and can expire if work does not start or stalls between inspections. On phased or financed work, keep the permit active with periodic progress inspections and confirm the expiry window before it passes.

Inspections in New York City

Where a permit is required, standard checkpoints include footing and foundation, framing, rough-in electrical, plumbing and mechanical, insulation and Energy Code compliance, fire systems on commercial work, and final, with a certificate of occupancy before use. The department schedules required inspections through its electronic system, and sign-off and the certificate of occupancy follow the code path for the work type.

New York inspections are keyed to the code edition in force when the permit issued, so the approved plans and the Energy Code documentation need to be on site for the inspector to check against. Local code enforcement officials are certified by the state, and the municipality reports its enforcement activity to the Department of State. Confirm the notice the Department of Buildings needs and schedule around its inspection windows.
